Bandung’s Special Committee 12 is facilitating a Draft Local Regulation (Raperda) on the administration and handling of social welfare to the West Java Provincial Government, which is confirmed as a new regulation rather than a revision.

Chairman Iman Lestariyono said the discussion initially focused on changes to Perda Number 24 of 2012. However, during the process, the substance changed by more than 50 percent, driven by new regulations, particularly from Permensos, necessitating adjustments. Therefore, the raperda is not merely a change.

Three main points are being considered in the raperda. First, strengthening and regulating the Social Welfare Institutions (LKS), including licensing and official registration obligations. In line with central government provisions, LKS licensing is issued by either the Ministry of Law and Human Rights (Kemenkumham) or local governments. With the new local regulation, Bandung City would have a stronger legal basis to supervise them.

Second, the raperda governs the collection of money and goods (PUB). Third, it addresses free prize draws (UGB).

Iman added that spontaneous activities such as fundraising within a local area during disasters do not require a special permit. If activities involve public figures and reach across regions, particularly via social media, reporting and a permit from the central government are required. “If the reach already extends across jurisdictions, there must be an permit,” Iman said.

To enrich the material, Pansus 12 also conducted a comparative study to Jakarta, including to the Ministry of Social Affairs. From the discussions and various inputs, it was agreed to repeal the old regulation before replacing it with the new regime.

Currently, the facilitation process is still ongoing at the provincial level. Pansus 12 targets the raperda to be enacted within the next month through a plenary session. “After notes from the province, if nothing is crucial, it can be quickly put to the plenary session,” concluded Iman.
