Bandung City DPRD Special Committee 12: Discussion of Social Welfare Regulation Draft Completed, Enters Evaluation Phase

The draft regulation on social welfare implementation in Bandung City has entered the harmonisation and evaluation stage. Previously, the Bandung City DPRD through Special Committee (Pansus) 12 had completed discussion of the regulation.

“Praise be to Allah, the discussion has been completed. What remains are consultation processes with relevant ministries and evaluation at the Ministry of Law and Human Rights,” said Susanto Triyogo Adiputro, a member of Pansus 12 of Bandung City DPRD.

Susanto stated that his team had conducted consultations with relevant ministries and evaluation at the Ministry of Law and Human Rights (Kemenkumham). However, the substantive discussion of the social welfare implementation regulation has been completed.

This draft regulation, according to Susanto, has a comprehensive scope covering government responsibility and authority, social welfare implementation, social welfare institutions (LKS), regulation of fund and goods collection (PUB), free prize lotteries (UGB), licensing, information systems, guidance, supervision, monitoring, evaluation, and financing.

“This regulation is formulated as a derivative of various latest ministerial social regulations to ensure implementation at the local level has a strong legal foundation and aligns with national provisions,” he said.

He added that regarding fund and goods collection (PUB), the regulation refers to Ministry of Social Affairs Regulation Number 8 of 2024. Several provisions incorporated into the local regulation concern licensing mechanisms and administrative sanctions.

Additionally, reporting obligations are established for PUB operators, including the obligation to attach public accountant audit reports for fund collection exceeding 500 million rupiah, as well as documentation of fund implementation and distribution. “Reporting becomes an important part to ensure transparency and accountability are guaranteed,” he said.

This PKS politician explained that for social welfare institutions (LKS), the regulation in this draft is derived from Ministry of Social Affairs Regulation Number 5 of 2024. The main focus is strengthening monitoring and evaluation patterns by local social services against the operations and governance of LKS.

“With this regulation, the local government has a clearer basis in guiding and supervising social institutions operating in its territory,” he said.

Meanwhile, regulations regarding free prize lotteries (UGB) refer to Ministry of Social Affairs Regulation Number 3 of 2024. “This provision regulates the licensing procedures, reporting, and supervision mechanisms for lottery operations to ensure compliance and prevent public harm,” said Susanto.

The purpose of this draft regulation is to strengthen the local government’s function in monitoring and evaluating all social association and welfare implementation activities. With such rules, the local government has clear mechanisms to follow up on findings or public reports, ranging from administrative sanctions to criminal penalties in accordance with applicable laws.

“This regulation is expected to create more orderly, transparent, and accountable governance of social welfare implementation, whilst protecting public interests,” he said.
