ARUKKI-LP3HI Sue KPK Over Three Allegedly Stalled Ministry of Agriculture Corruption Cases
The Alliance of the People for Justice and Welfare (ARUKKI) and the Indonesian Law Enforcement Oversight Institute (LP3HI) have sued the Corruption Eradication Commission (KPK) over the alleged stalling of investigations into suspected corruption at the Ministry of Agriculture (Kementan) during 2020–2022. Three clusters of alleged corruption at the ministry form the basis of the lawsuit.
Legal counsel for ARUKKI and LP3HI, Boyamin Saiman, explained that the first hearing under case number 13/Pid.B/2026 was held at the South Jakarta District Court on Friday (20 February 2026). According to Boyamin, his clients filed the lawsuit against KPK using Article 158(e) of the new Criminal Procedure Code (KUHAP), which states:
“The District Court has the authority to examine and decide, in accordance with the provisions of this Law, matters concerning: (a) the legality of the use of coercive measures; (b) the legality of the termination of investigation or prosecution; (c) requests for compensation and/or rehabilitation for persons whose criminal cases were terminated at the investigation or prosecution stage; (d) seizure of objects or goods unrelated to a criminal offence; (e) delays in case handling without valid reason; and (f) suspension of detention deferral.”
The article invoked is Article 158(e), which provides that the District Court has the authority to examine and rule on delays in case handling without valid reason.
“The basis of this lawsuit is Article 158 paragraph (e) of the new KUHAP, which regulates pre-trial objects including delays in case handling. This legal basis is new in the KUHAP, which strengthened our resolve to file a lawsuit over stalled case handling by law enforcement officials,” Boyamin told reporters.
Boyamin explained that there are three clusters of alleged corruption cases at the Ministry of Agriculture during 2020–2022 that have allegedly been stalled at the KPK. The first, he said, involves the procurement of Foot and Mouth Disease (FMD) vaccines, which allegedly caused state losses of Rp 75.7 billion.
“On 15 June 2022, the Ministry of Agriculture procured Secure QR Code Ear Tags, based on Minister of Agriculture Decree Number SS9/KPTS/PK.300/M17/2022 on Livestock Marking and Registration for Foot and Mouth Disease Control,” Boyamin said.
“The Supreme Audit Agency (BPK) further revealed overpayments in the procurement of FMD vaccines, potentially causing state losses of Rp 75.7 billion,” he added.
Boyamin said the case had originally been disclosed by Alexander Marwata, who was then serving as KPK Deputy Chairman. Reports regarding the case, according to Boyamin, were received by the KPK in 2020, and by 2021 the leadership had already issued a disposition letter to the enforcement division.
“Through KPK Deputy Chairman Alexander Marwata, the public complaint had already been received by the Public Complaints section in 2020, and according to him, in 2021 the leadership had already issued a disposition letter to the enforcement division to follow up the report by conducting a preliminary investigation,” he said.
Boyamin assessed that no follow-up action was taken after the disposition order. He considers that the KPK delayed the case without valid reason.
“Given that the leadership’s disposition order was not followed up as it should have been, the petitioners therefore consider that the respondent has carried out a delay in case handling without valid reason,” he said.
Boyamin stated that the second case concerns the procurement of ear tags or secure QR code-based livestock markers, and the third case relates to cattle procurement. He noted that to date, there has been no resolution of the cases nor any designation of suspects among the parties involved.
“Based on the chronology and findings from media reports, it is suspected that the Ministry of Agriculture committed acts of corruption in the procurement of secure QR code ear tags for livestock marking and registration, yet the respondent has to this day not resolved the case nor designated suspects against other parties involved in the corruption case,” he said.
Alexander Marwata Previously Revealed Corruption Report at Ministry Was Shelved for Three Years
Previously, in 2023, Alexander Marwata, who was then still serving as KPK Deputy Chairman, had revealed that a report of alleged corruption at the Ministry of Agriculture had been left unattended upon receipt at the KPK. The report was not followed up for three years.
Alexander initially explained about the case-handling monitoring system at the KPK. He described it as one of the vulnerable points within the commission.
“There is a vulnerable point in case handling at the KPK, relating to the supervision or monitoring of case handling,” Alexander said at the KPK building in South Jakarta on Monday (27 November 2023).
Alexander then disclosed that a corruption report at the Ministry of Agriculture had gone unhandled. The report had been received by the KPK since 2020.
According to Alexander, the report only came to light when the KPK was investigating the extortion case at the Ministry of Agriculture that led to the designation of Syahrul Yasin Limpo (SYL) as a suspect.
“When we were dealing with the case in which we subsequently designated a suspect in connection with extortion, we were completely in the dark, unaware that in 2020 there had been a public complaint,” he said.
Alexander did not elaborate on the specifics of the corruption report that had been shelved. He said the report had since been elevated to the preliminary investigation stage.
“And it turned out the leadership had also issued a disposition to conduct a preliminary investigation. But it was never followed up — only recently did we order it to be actioned with a formal investigation order,” Alexander said.
“What does this mean? From 2020 to 2023, three years it was left idle. This was poorly monitored, and the leadership had no mechanism to monitor whether leadership dispositions were followed up or not,” he added.
