SEMARANG — Legal enforcement proceedings regarding alleged partnership violations between large enterprise PT Adonia Footwear Indonesia (PT AFI) and micro, small, and medium enterprise (MSME) CV New Kuda Mas have now entered the investigation phase under the Commission for the Supervision of Business Competition (KPPU).

KPPU Regional Office VII Central Java–DIY conducted a two-hour-plus examination of CV New Kuda Mas at the Cyber Investigation Directorate Building (Ditressiber) of the Central Java Police in Semarang on Friday, 22 March, from 09:00 to 11:30 WIB.

During the examination, which forms part of the investigation into alleged partnership violations in the non-hazardous waste management services sector involving foreign direct investment enterprise PT AFI in Tegal Regency, CV New Kuda Mas was accompanied by a legal team from NAZ Law Clinic, comprising Dr. Naya Amin Zaini, S.H., M.H., Munawir, S.H., M.H., and H. Fathoni Mansur, S.H.

The KPPU investigation team posed approximately 30 detailed questions, documented in an Investigation Report, to uncover alleged partnership violations committed by the large company against the MSME.

According to Dr. Naya Amin Zaini, the examination followed up on Call Letter Number 438/DH/P/III/2026 and investigation case number 03-03/DH/KPPU-PK.L/II/2026 concerning alleged violations of partnership provisions as regulated in Law Number 20 of 2008 on Micro, Small, and Medium Enterprises, particularly the obligation of large enterprises to establish fair partnerships with MSME operators.

Dr. Naya also stated that the complaint to KPPU was filed after his client suffered material and immaterial losses due to alleged discriminatory treatment in a partnership relationship previously approved by the Ministry of Investment/BKPM RI.

“However, the partnership cooperation resulted in significant losses for MSME operator CV New Kuda Mas, which should have received legal protection within Indonesia’s investment ecosystem,” he said following the examination.

Dr. Naya Amin Zaini further emphasised that the legal step to KPPU forms part of efforts to seek justice for MSME CV New Kuda Mas, which felt wronged in its partnership relationship with the large enterprise.

“We are assisting CV New Kuda Mas to ensure that this alleged partnership violation is examined seriously. MSMEs must not be treated discriminatively in business relations with large enterprises, especially if the partnership has been ratified by the state,” he stated firmly.

The legal team of CV New Kuda Mas also expressed appreciation for KPPU Regional Office VII Central Java–DIY for following up on the report professionally through report handling notification letter Number 29.1/Wil.VII/S/II/2026.

According to Dr. Naya, this KPPU action is important as a form of law enforcement in the business partnership sector involving MSMEs and large enterprises.

“We appreciate KPPU for processing this report professionally in accordance with regulations. Our hope is that the legal enforcement process runs fairly, with integrity, and provides legal certainty for MSMEs,” he said.

Deterrent Effect and Improvement of Investment Governance

Furthermore, Dr. Naya Amin Zaini expressed hope that this legal process could serve as an important lesson for business partnership practices in Indonesia to prevent discriminatory treatment of MSME operators from recurring.

“This case is not merely about the losses experienced by our client, but also about protection for MSMEs throughout Indonesia. Firm law enforcement will provide a deterrent effect and improve investment governance so that partnerships run fairly and do not harm small business operators,” said Dr. Naya.

Additionally, the legal team of CV New Kuda Mas also reaffirmed its support for government policy in promoting real economic growth through partnerships between large enterprises and MSMEs. However, such partnerships must proceed without discrimination, without exploitation, and without harming small business operators who are an important part of the national economic ecosystem.
