Young Islamic Scholar Explains Permissibility of Qurban Using APBN, Allowed If Conditions Met
During this year’s Eid al-Adha celebrations, questions have arisen among the public regarding the permissibility of government or state institutions performing qurban using APBN or APBD funds. The question emerged after President Prabowo Subianto purchased 1,098 cattle for qurban using APBN with a budget of Rp 100 billion. In response, KH Ahmad Muhamad Mustain Nasoha, who heads the Raudlatul Muhibbin Al Mustainiyyah Islamic boarding school in Surakarta and serves as the Fatwa Chairman of the Surakarta branch of the Indonesian Ulema Council (MUI), explained that this is permissible under Islamic law provided certain conditions are met. “Classical fiqh literature states that it is permissible for an imam or leader to perform qurban on behalf of Muslims using state funds when the national finances are sufficient and do not interfere with the people’s basic needs,” Gus Mustain told Republika.co.id on Wednesday (27 May 2026). Gus Mustain, his common nickname, explained that there is at least one hadith stating that Prophet Muhammad SAW performed qurban with two goats each year. One was for his personal sacrifice and the other intended for his community. This hadith has been cited by some scholars as the basis for the permissibility of collective qurban or qurban conducted by institutions or the government on behalf of the public. In the book Hasyiyah asy-Syarwani, volume 9, page 349, Egyptian scholar Sheikh Abdul Hamid Syarwani explicitly states: وَيُسَنُّ لِلْإِمَامِ أَنْ يُضَحِّيَ مِنْ بَيْتِ الْمَالِ عَنْ الْمُسْلِمِينَ بَدَنَةً فِي الْمُصَلَّى وَأَنْ يَنْحَرَهَا بِنَفْسِهِ رَوَاهُ الْبُخَارِيُّ وَإِنْ لَمْ تَتَيَسَّرْ بَدَنَةٌ فَشَاةٌ وَإِنْ ضَحَّى عَنْهُمْ مِنْ مَالِهِ ضَحَّى حَيْث شاء
