Witness Retracts BAP Statement on CPO and PK Sales Data in LPEI Corruption Trial
Former PT Tebo Indo Sales Manager Tjin Supardi retracted part of his statement in the official investigation report (BAP) while testifying in a trial concerning alleged corruption in export financing at the Indonesian Export Financing Agency (LPEI) at the Jakarta Corruption Court. The retraction relates to crude palm oil (CPO) and palm kernel (PK) sales data listed in a table within the investigation report.
The panel of judges initially probed the origin of the data in the table after Tjin explained that he had previously created documents related to CPO and PK. However, Tjin asserted that the data in the table did not come from his direct knowledge.
Tjin explained that during the investigation, he told investigators he remembered creating CPO and PK documents addressed to Sungai Budi. However, the data subsequently entered into the report was said to have come from another person’s statement. “At that time, with Mr Hadi, I said I remembered creating CPO and PK documents that were not addressed to Sungai Budi. Then Mr Hadi opened the BAP of Mrs Elana, who works at Budi Nabati Perkasa,” Tjin said in court.
The judge then confirmed whether the data in the table was indeed not from the documents the witness had created. “In essence, you have created them, but not the ones mentioned in the table?” the judge asked. “Yes,” Tjin replied.
The panel of judges then reaffirmed the witness’s position on the previous statement in the BAP. Tjin stated he was retracting that part of his testimony. The judge also reminded him that his statements and testimony were entirely his responsibility and must not be influenced by any party during the trial.
Tjin further stated he did not know the detailed data in the table because the information came from the BAP of Elana, an employee of PT Budi Nabati Perkasa. “I don’t know the details,” he said.
According to Tjin, during the investigation he was asked to search for data on both existing and non-existent transactions. However, for the CPO and PK data in question, he admitted he could not find supporting documents in his possession. “At that time, I did not find the CPO and PK data. But I had to search. So I had no data with me,” he said.
After hearing the explanation, the panel of judges concluded that the witness had indeed created documents related to CPO and PK, but the documents mentioned in the table in the BAP were not data known or created directly by Tjin. “So what you created, you did not find in that table,” the judge said, which Tjin confirmed. The panel of judges then declared the testimony retracted and the examination proceeded to other matters.
