Winning Dispute at Supreme Court, Banten Provincial Government to Reorganise Situ Rancagede

The Supreme Court (MA) has granted the cassation petition filed by the Banten Provincial Government regarding the dispute over Situ Rancagede in Serang Regency. The province will now begin reorganising the lake.

The Supreme Court’s ruling cancels the decision of the Jakarta High Administrative Court (PT TUN), which had previously ruled in favour of the lawsuit by PT Modern Industrial Estate (Modern Cikande).

Ruling Number 6 K/TUN/2026 states that Situ Rancagede, the object of the lawsuit, now belongs to the Banten Provincial Government. Currently, the Situ Rancagede area is an industrial zone.

“We’ll sort it out first. It’s the most potential one. Because there was a big businessman managing it initially,” said Banten Deputy Governor Dimyati Natakusumah on Wednesday (29/4/2026).

Dimyati said he would inventory the problems at Situ Rancagede. According to him, many parties have been ‘playing’ on the land there.

“We’ll inventory what problems there are, then we’ll review them, because many parties are involved in Rancagede,” said Dimyati.

The Provincial Government will first study the ruling. After that, it will immediately execute the takeover.

“It’s already final, but still controlled. We want to study the ruling in detail, after that we’ll take control. We’ll look at the third parties who have controlled the land, we’ll inventory them,” he said.

He emphasised that all situ are state property. However, the Provincial Government is open to opportunities for cooperation regarding management.

“The option is that we take control, then we can also collaborate, but the main point is for the benefit of the people,” he said.
