Why Can Certified Land Still Be Challenged? Here's the Explanation

JAKARTA, KOMPAS.com - For many people, owning a land certificate is often seen as absolute proof of ownership. This official document issued by the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) is indeed a symbol of legal certainty. However, behind that, one question frequently arises: can certified land truly not be challenged? The answer is not entirely so. In Indonesia’s land law system, the land certificate is recognised as strong evidence of rights, but not the most absolute. This means that the ownership stated in the certificate can still be questioned if another party can demonstrate stronger evidence in court. “The certificate is strong evidence of rights, as long as no other party can prove otherwise,” stated in various instances, as quoted by Kompas.com on Friday (10/4/2026). Simply put, the data in the certificate is presumed correct, but it still allows room for correction through legal mechanisms. In practice, disputes over certified land are not uncommon, one of the main causes being administrative flaws, such as data errors, overlapping land, or issuance processes not in accordance with procedures. In certain conditions, the court can cancel the certificate if violations of the law are proven. Another factor that often arises is long-term physical possession of the land. In some cases, this condition also becomes a consideration for judges in deciding disputes. This situation shows that the certificate is not an “absolute shield”, but rather part of a proof system that must still be supported by the validity of the process and data. Clarity of land history, land boundaries, and supporting documents become important factors in minimising potential disputes. Ultimately, the land certificate does provide strong legal protection. However, true certainty lies not only in the document, but also in the correct and transparent process from the beginning.
