Whip Pink Boss Baffled by Health Law Charges
The director of PT Suplaindo Sukses Sejahtera (SSS) has requested a special case review regarding the naming of suspects in the production of nitrous oxide (N2O) gas under the ‘Whip Pink’ brand. The legal representative for the two suspects, Andi Hioe and Jasen Hioe, Rizky Hariyo Wibowo, stated that the review was sought because his clients are baffled by the use of Law Number 17 of 2023 on Health in this case. “We are submitting a request for a special case review at Bareskrim to test whether the legal basis used by Bareskrim is appropriate based on the minimum of two pieces of evidence. That is what we are testing in this special case review mechanism,” he told reporters at Bareskrim Polri on Thursday (23/7).
Rizky explained that his clients’ product, Whip Pink, which contains N2O gas, is a food additive for the culinary industry. Therefore, he argued it is inappropriate to charge them under Article 435 of the Health Law. “We want to clarify why Whip Pink, which clearly falls into the food additive industry category, can be linked and charged with Article 435 of the Health Law, which regulates pharmaceutical preparations and medical devices,” he explained. “There are several segments for N2O. Besides medical use, it is also used as a propellant or food additive, which is regulated under a different legal regime. So, it is clear that Whip Pink belongs to the culinary industry,” he added.
Following reports of victims allegedly due to Whip Pink consumption, Rizky said his clients had sought clarification from the Food and Drug Supervisory Agency (BPOM) regarding the licensing mechanism for N2O products as food additives. He stated this was raised directly with BPOM during a meeting on 27 February 2026. However, Rizky mentioned that his clients did not receive clarity on the procedures for obtaining distribution permits and fulfilling all administrative requirements. “Our clients’ information indicates they have asked before, but the answer was that there are no regulatory provisions or distribution permits yet. In our view, that should also be questioned to BPOM, whether such regulations actually exist,” he said.
Previously, the Narcotics Crime Directorate of Bareskrim Polri decided to detain Andi Hioe and Jasen Hioe, suspects in the N2O gas production case at PT Suplaindo Sukses Sejahtera. The Head of Sub-Directorate III of Narcotics Crime at Bareskrim Polri, Kombes Zulkarnain, stated that the detention was carried out after the two, who had been named suspects, underwent examination on Wednesday (22/7). “Both have been detained at the Bareskrim Polri detention centre as of 22 July 2026 at 23:24 WIB,” Zulkarnain confirmed on Thursday (23/7). They are detained for 20 days until 10 August 2026. Investigators charged Andi Hioe and Jasen Hioe under Article 435 of the Health Law.
The Whip Pink distribution case has entered the investigation stage, beginning with the uncovering of 16 product warehouses in 12 cities owned by PT Suplaindo Sukses Sejahtera, which lacked legality and BPOM distribution permits. The 16 Whippink warehouses are located in Jakarta (5 warehouses), Bandung (2), Makassar (1), Semarang (1), Yogyakarta (1), Balikpapan (1), Surabaya (1), Medan (1), Bali (2), and Lombok (1). Regarding turnover, the company reportedly earned illegal profits from Whip Pink sales ranging from IDR 2.1 billion to IDR 7.1 billion over the last six months. In this case, investigators have not yet named additional suspects, although nine PT SSS employees were previously detained for examination as part of the case development.
