The Jakarta Administrative Court (PTUN) has officially declared the lawsuit filed by the Lyceum Kristen Association (PLK) against the Directorate General of General Legal Administration (Ditjen AHU) of the Ministry of Law as inadmissible (Niet Ontvankelijk Verklaard/NO). This ruling strengthens the legal position of the West Java Provincial Government regarding ownership of state assets in the Dago 93 area, which currently functions as the building for SMAN 1 Bandung.

West Java Governor Dedi Mulyadi welcomed the decision and expressed appreciation to all parties who have consistently safeguarded state assets. According to him, the judge’s ruling was very appropriate and provides certainty for the education sector. “Thank you, the judge has been objective so that we can manage the school properly and the children can be at ease,” said Dedi Mulyadi.

Jutek Bongso, legal counsel for the West Java Governor from the Jabar Istimewa Team, explained that the Jakarta PTUN ruling proves that PLK’s attempt to seize the land has no legal basis. He stressed that PLK’s legal entity status should have been inactive, meaning it lacked the legal capacity to file a lawsuit. “Their legal defeat against the Ministry of Law alone shows that this organisation is prohibited and dissolved; it has no legal standing,” Jutek asserted.

Regarding further legal steps, Jutek stated that his party is still waiting for a legally binding decision (inkrah). Although there is a possibility that PLK may appeal, he is optimistic that the judiciary will continue to recognise the organisation’s illegitimacy. Once the ruling is legally binding, the Jabar Istimewa Team plans to bring the matter to the criminal domain. “We are still waiting to bring them to the criminal justice system. If we file a police report now, the results will not be optimal because we would have to wait again if they file an appeal,” he added.

The Jakarta PTUN ruling, announced on Wednesday, was related to the Decree of the Minister of Law Number: AHU-08.AH.01.43 Year 2025 concerning the revocation of a previous ministerial decree. The revocation was based on a prior court decision. Fitra Kadarina, Head of the Business Entity Advocacy Working Team at the Directorate General of General Legal Administration, stated that the state’s authority to safeguard its assets is now stronger. She revealed that, according to official data, PLK had actually been dissolved by the government since 1984. The judge considered the defendant’s actions to be reasonable, referring to a criminal ruling and a civil ruling from the Bandung District Court. With this decision, the status of the SMAN 1 Bandung land on Jalan Dago 93 remains under government management, providing a sense of security for the hundreds of students and teaching staff active there.
