West Java Governor Applauds Jakarta Administrative Court for Dismissing PLK Lawsuit

West Java Governor Dedi Mulyadi has expressed his appreciation after the Jakarta State Administrative Court (PTUN) officially declared the lawsuit filed by the Christian Lyceum Association (PLK) against the Directorate General of General Legal Administration (AHU) at the Ministry of Law as inadmissible (Niet Ontvankelijk Verklaard/NO), thereby strengthening the legal status of SMAN 1 Bandung as a legitimate state asset. The ruling thwarted PLK’s attempt to reclaim the strategic land in the Dago 93 area of Bandung City, after the panel of judges assessed that the community organisation had absolutely no legal standing to file the lawsuit. “Thank you, the judge has been objective so we can manage the school properly and the children can be at ease,” said Dedi Mulyadi in a statement in Bandung on Saturday, responding to the decision. The legal counsel for the West Java Governor from the Jabar Istimewa team, Jutek Bongso, explained that PLK’s defeat at the PTUN serves as authentic proof that the association is a prohibited organisation whose legal entity status has been dissolved by the state. Jutek stated that his party is now preparing to bring the individuals acting on behalf of PLK into the criminal justice system once the ruling becomes legally binding. “We are still waiting to bring them to the criminal realm because we suspect they will appeal the PTUN decision. If we file a police report now, the result will not be optimal because we would have to wait again if they proceed with an appeal,” said Jutek. The land dispute over SMAN 1 Bandung arose after the Minister of Law issued Decree Number: AHU-08.AH.01.43 Year 2025, which revoked PLK’s legal entity status. “We are very pleased with this PTUN ruling. It means the state’s authority to protect its assets is increasingly strengthened against threats from PLK,” said Fitra. In its legal considerations, the panel of administrative court judges stated that the Ministry of Law’s decision referred to the Bandung District Court Criminal Decision Number: 811/Pid.B/2017/PN.Bdg and the Civil Decision Number: 228/Pdt.G/2022/PN.Bdg. In the civil ruling, the court conclusively declared that PLK was proven not to be a continuation of the Het Christelijk Lyceum (HCL) from the Dutch East Indies era, and declared the Deed of Establishment Number 3 of 2005 concerning the association null and void.
