West Java DPRD Special Committee Finalises Environmental Protection Draft Regulation with Stricter Sanctions
The Special Committee (Pansus) XV of the West Java DPRD, in collaboration with the West Java Provincial Government, has finalised the discussion of the Draft Regional Regulation (Raperda) concerning the Implementation of Environmental Protection and Management (P3LH). The draft introduces stricter sanctions and enhanced supervision for repeated environmental violations.
The refinement of the regulatory draft, which includes discussions up to Article 122, clarifies the division of authority between the Environmental Agency (DLH) and the Department of Investment and One-Stop Integrated Services (DPMPTSP). This is intended to provide legal certainty and ensure the enforcement of both administrative and criminal sanctions in the field.
“We are grateful that the Committee’s discussions have concluded. Several articles have been corrected together to ensure relevance to current conditions. Everything has been agreed upon and is clear. We hope this Regional Regulation will serve as a strong primary fortress in maintaining environmental sustainability in West Java,” said the Chairman of Special Committee XV of the West Java DPRD, Jenal Arifin, in a statement in Bandung on Tuesday.
Jenal explained that the adjustments to the articles within the P3LH Draft Regulation involved the systematic structure, numbering, and the clarity of facilitating environmental infrastructure and facilities between the provincial government and regency/city governments, without altering the fundamental substance previously agreed upon.
The agreed clauses of the environmental regulation will subsequently be submitted to the Ministry of Home Affairs (Kemendagri) and the Ministry of Environment (KLH) to undergo the legal facilitation and harmonisation process before being officially enacted as a Regional Regulation.
The Head of the West Java Provincial Environmental Agency (DLH), Ai Saadiyah Dwidaningsky, expressed appreciation for the comprehensive oversight by the legislative body to produce an applicable legal umbrella for all areas of West Java.
“The agreement on all clauses as of 1 October serves as our basis to proceed to the submission stage to the Ministry of Home Affairs and the Ministry of Environment. We appreciate Special Committee XV for their very comprehensive guidance towards achieving a high-quality and implementable Regional Regulation,” said Ai.
