Verdict Hearing for Noel Ebenezer Scheduled for Today

The verdict hearing for the 2024-2025 period Deputy Minister of Manpower, Immanuel ‘Noel’ Ebenezer Gerungan, is scheduled to face the reading of the judges’ decision regarding allegations of extortion in the management of K3 (Occupational Health and Safety) certificates at the Corruption Court of the Central Jakarta District Court on Thursday (4/6).

The Central Jakarta District Court’s Case Tracking Information System (SIPP) indicates that the verdict session will commence at 10:00 WIB in the Kusuma Attekmadja courtroom, presided over by Chief Judge Nur Sari Baktiana.

Previously, Noel faced a prison sentence demand of five years, a fine of Rp250 million (subsidised by 90 days in prison), and restitution of Rp4.43 billion (subsidised by two years in prison). In the case involving alleged extortion in the processing of K3 certificates within the Ministry of Manpower and related gratifications, he was indicted for extorting K3 certification or licence applicants for a total of Rp6.52 billion and receiving gratifications.

The extortion was allegedly carried out by Noel alongside 10 other defendants, namely Temurila, Miki Mahfud, Fahrurozi, Hery Sutanto, Subhan, Gerry Aditya Herwanto Putra, Irvian Bobby Mahendro Putro, Sekarsari Kartika Putri, Anitasari Kusumawati, and Supriadi.

Sentencing demands for the other defendants vary: Temurila and Miki Mahfud were each sentenced to 3 years; Fahrurozi to 4 years and 6 months; Subhan, Gerry Aditya Herwanto Putra, Sekarsari Kartika Putri, Anitasari Kusumawati, and Supriadi to 5 years and 6 months each; Irvian Bobby Mahendro Putro to 6 years; and Hery Sutanto to 7 years. In addition to prison terms, the 10 defendants were also faced with fines of Rp250 million, subsidised by 90 days in prison.

Furthermore, several defendants were ordered to pay restitution for the corruption funds they received, including Hery (Rp4.73 billion), Subma (Rp5.8 billion), Gerry (Rp13.26 billion), Bobby (Rp60.32 billion), Sekarsari (Rp42.67 billion), Anita (Rp14.49 billion), Supriadi (Rp19.81 billion), and Fahrurozi (Rp233.01 million), each subsidised by 2 years in prison.

The alleged extortion targeted several K3 certification applicants, including Fanny Fania Octapiani, Fransisca Xaveriana, Grhadini Lukitasari Tasya, Intan Fitria Permatasari, Muhammad Deny, Nicken Ayu Wulandari, Nur Aisyah Astuti, Octavia Voni Andari, Shalsabila Salu, and Sri Enggarwati.

Detailed records show the extortion was intended to benefit the defendants currently on trial: Noel gained Rp70 million; Fahrurozi Rp270.95 million; Hery, Gerry, and Sekarsari each Rp652.24 million; Subhan and Anitasari each Rp326.12 million; Bobby Rp978.35 million; and Supriadi Rp294.06 million. Other beneficiaries included Haiyani Rumondang (Rp381.28 million), Sunardi Manampiar Sinaga (Rp288.17 million), Chairul Fadhly Harahap (Rp37.94 million), Ida Rochmawati (Rp652.24 million), and Fitriana Bani Gunaharti and Nila Pratiwi Ichsan (each Rp326.12 million).

Meanwhile, the gratifications allegedly received by Noel amounted to Rp3.36 billion and one unit of a navy blue Ducati Scrambler motorcycle, provided by civil servants within the Ministry of Manpower and other private parties during his tenure as Deputy Minister.

For these actions, the former Deputy Minister faces charges under Article 12 letter e or Article 12 letter b and Article 12 B in conjunction with Article 18 of Law Number 31 of 1999 on the Eradication of Corruption Crimes, as amended by Law 20 of 2001, in conjunction with Article 20 letter c and Article 127 paragraph (1) of the National Criminal Code.
