US Crypto Regulations Unresolved as Clarity Act Stalls in Senate

The establishment of a regulatory framework for digital assets in the United States continues to face uncertainty after the Clarity Act failed to secure sufficient support to proceed in the US Senate. This development comes amidst pressure on the crypto market, with Bitcoin and Ethereum recording declines on 16 September 2026.

On 15 September 2026, local time, the US Senate failed to advance the Clarity Act after a procedural vote resulted in 50 votes to 49. This result fell below the three-fifths threshold required to continue the deliberation process.

The vote was a procedural measure rather than a final rejection of the entire bill. According to available reports, Senator Thom Tillis changed his vote to ‘no’ during the session, meaning the Clarity Act can still be considered through subsequent processes.

The Clarity Act is designed to establish a federal regulatory framework for digital assets, including defining the division of authority between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTlag).

Ryan Lymn, Chief Operating Officer of Bittime, stated that these developments demonstrate that the process of forming a regulatory framework for digital assets remains complex.

“The developments regarding the Clarity Act show that establishing a regulatory framework for digital assets requires a sufficiently complex process of discussion. Although the recent procedural vote did not allow the bill to move forward, discussions regarding market structure and the division of regulatory authority remain vital to the development of the digital asset industry,” Ryan said on Thursday (17/9/2026).

Prior to the vote, the Clarity Act draft had undergone several amendments. According to an official release from Senator Cynthia Lummis on 14 September 2026, the latest version of the bill contains 126 substantive changes resulting from bipartisan discussions.

These changes include provisions regarding stablecoins, ethics, the role of state attorneys general in enforcement, and updates to the Blockchain Regulatory Certainty Act.

These regulatory developments occur while the crypto market is under pressure. According to CoinMarketCap data on the morning of 16 September 2026, Bitcoin was trading around $75,513, down 3.07 per cent within 24 hours and 4.10 per cent over seven days.

Ethereum was also trading around $2,400, down 4.58 per cent in 24 hours and 3.65 per cent over seven days. However, crypto asset price movements cannot be attributed solely to the Clarity Act developments, as the market is influenced by various factors.

In a Reuters report, Bitcoin and several crypto-related stocks reportedly faced pressure following the vote. This condition indicates that regulatory developments are one of the key factors being monitored amidst the dynamics of the digital asset market.

Ryan noted that regulatory developments should be viewed as one part of the overall market condition. “Regulation is not the sole factor determining the price movement of crypto assets. Therefore, understanding market conditions, asset characteristics, and the risks of each product remains essential for market participants,” he explained.

Global crypto market developments are reflected not only in spot trading but also include activity in the derivatives market. In derivatives trading, market participants can take long or short positions based on expectations of asset price movements.

Unlike spot trading, which involves the direct purchase or sale of assets, futures allow users to take positions based on the price movement of an asset through contracts. The use of leverage can increase exposure while simultaneously magnifying potential losses.

Consequently, derivatives trading requires an understanding of contract mechanisms, leverage, margin, volatility, and the inherent risks of such instruments.

The developments regarding the Clarity Act show that the formation of digital asset rules in the United States remains dynamic. While the regulatory process continues, market conditions remain influenced by various factors, meaning policy developments must be interpreted alongside the overall dynamics of digital asset trading.
