Two Private Sector Defendants Face Three-Year Prison Sentence in OSH Extortion Case
JAKARTA — Two defendants representing PT KEM, Temurila and Miki Mahfud, have been sentenced to three years in prison following allegations of extortion related to the processing of Occupational Safety and Health (OSH) certificates at the Ministry of Manpower. During the sentencing hearing at the Jakarta Corruption Court on Monday (18/5/2026), the Corruption Eradication Commission (KPK) prosecutors stated that both defendants were proven guilty of corruption.
“The prosecution seeks a prison sentence of three years for Defendant 1, Temurila, and Defendant 2, Miki Mahfud,” the prosecutor explained during the session. “Additionally, a fine of Rp250,000,000 is sought for each defendant.”
The prosecution noted several aggravating factors in the case, stating that the defendants failed to support government programmes aimed at achieving a government free from corruption, collusion, and nepotism. Conversely, the prosecution noted mitigating circumstances, observing that the defendants’ actions were driven by intentional factors.
The charges are brought under Article 5, paragraph (1) letter b of the Corruption Eradication Law, in conjunction with Article 20 letter c and Article 127, paragraph (1) of the Indonesian Criminal Code.
In addition to the private sector defendants, the case also implicates officials from the Ministry of Manpower, including the former Deputy Minister of Manpower, known as Noel. Noel and other officials are accused of receiving Rp6.5 billion through the extortion of OSH certificate and licence applicants.
“The prosecution alleges that Immanuel Ebenezer Gerungan, acting alongside Fahrurozi, Hery Sutanto, Subhan, Gerry Aditya Herwanto Putra, Irvian Bobby Mahendro, Sekarsari Kartika Putri, Anitasari Kusumawati, Supriadi, Miki Mahfud, and Temurila, coerced applicants for OSH certification and licensing to provide funds totalling approximately Rp6,522,360,000,” the prosecutor stated. According to the prosecution, this extortion scheme has been ongoing since 2021.
