Two Former Pertamina Executives Sentenced to 6 Years in Prison in Crude Oil Case

Two former executives of PT Pertamina (Persero) have been sentenced to six years’ imprisonment in a corruption case involving the governance of crude oil and refinery products at PT Pertamina Subholding and Contractors under the Joint Operating Contract (KKKS) from 2018 to 2023.

The two defendants are Alfian Nasution, who served as VP of Supply and Distribution at PT Pertamina from 2011 to 2015, and Hanung Budya, who was Director of Marketing & Trading at PT Pertamina in 2014. Alfian also held the position of President Director of PT Pertamina Patra Niaga from 2021 to 2023.

“The Defendants Alfian Nasution and Hanung Budya Yuktyanta have been legally and convincingly proven guilty of jointly committing the criminal act of corruption as per the primary indictment of the public prosecutor,” stated the chief judge Adek Nurhadi while reading the verdict at the Corruption Court (Tipikor) at the Central Jakarta District Court on Tuesday (12/5).

The two defendants were also ordered to pay a fine of Rp1 billion each.

“If the fine is not paid within the specified period, the convicted person’s assets or income may be seized and auctioned to settle the unpaid fine,” the judge said.

“If the convicted person’s assets and income are insufficient to pay the fine, it shall be replaced with imprisonment for 160 days,” he added.

The verdict was not unanimous. Member judge 4 Mulyono Dwi Purwanto issued a dissenting opinion, expressing doubts about the procedure for calculating the amount of financial or economic loss to the state in this case.

In delivering the verdict, the judges outlined several aggravating and mitigating factors.

The aggravating factor is that the defendants’ actions do not support the government’s ongoing intensive efforts to combat corruption offences.

The mitigating factors include the defendants’ cooperative attitude during the trial, their family responsibilities, lack of prior convictions, and advanced age.

This verdict has not yet acquired legal force or become final, as the parties have a maximum of seven working days to express their stance.

Previously, the Public Prosecutor demanded that Alfian be sentenced to 14 years’ imprisonment, a fine of Rp1 billion subsidiary to 190 days’ imprisonment, and restitution of Rp5 billion subsidiary to seven years’ imprisonment.

Hanung was demanded to receive eight years’ imprisonment and a fine of Rp1 billion subsidiary to 190 days’ imprisonment, along with restitution of Rp5 billion subsidiary to five years’ imprisonment.
