Two Entrepreneurs Face Three-Year Prison Sentence Over Noel Ebenezer Bribery Case

Prosecutors from the Corruption Eradability Commission (KPK) have demanded a three-year prison sentence and a fine of Rp250 million (subsidised by 90 days in prison) for Temurila and Miki Mahfud, representatives of PT Kem Indonesia. The prosecutors stated that the defendants were proven to have bribed several officials within the Indonesian Ministry of Manpower regarding the management of Occupational Health and Safety (K3).

The alleged bribe amount totals approximately Rp6.58 billion. This was substantiated by legal facts presented during the trial, including the examination of 42 witnesses, hundreds of documents, defendant testimonies, 1,216 pieces of evidence, additional evidence (I to V), and electronic evidence.

“Sentencing Defendant I, Temurila, and Defendant II, Miki Mahfud, to three years of imprisonment each, and imposing a fine of Rp250 million each, subsidised by 90 days in prison,” stated the KPK prosecutor while reading the indictment at the Corruption Crime Court (Tipikor) of the Central Jakarta District Court on Monday (18/5).

The prosecutors determined that both defendants violated Article 5, paragraph 1, point b of the Law on the Eradication of Corruption Crimes, in conjunction with Article 20 C and Article 127, paragraph 1 of the Criminal Code (KUHP).

In delivering the sentencing demand, the prosecutor highlighted several aggravating and mitigating factors. The aggravating factor is that the defendants’ actions do not support the government’s programme to achieve a government free from Corruption, Collusion, and Nepotism (KKN). Mitigating factors include the defendants’ honesty in admitting their actions, their lack of prior criminal records, their family responsibilities, and their polite conduct during the trial.

Several Ministry of Manpower officials identified as recipients of the bribes include former Deputy Minister of Manpower Immanuel Ebenezer (also known as Noel Ebenezer) and Irvian Bobby Mahendro, the Commitment Making Officer (PPK) at the Directorate General of Labour Inspection and Occupational Health and Safety (Ditjen Binwasnaker & K3). Other officials named include Gerry Aditya Herwanto Putra, Subhan, Hery Sutanto, Anitasari Kusumawati, Fahrurozi, Sekarsari Kartika Putri, and Supriadi, each of whom received varying amounts of money.
