Two Educational Units Officially Under UIN Jakarta; Unilateral Claims Will Face Legal Consequences
The Ministry of Law of the Republic of Indonesia, through the Directorate General of General Legal Administration (AHU), has officially established and recorded the legitimate management of educational foundations that are in the process of management integration under UIN Syallif Hidayatullah Jakarta. With the issuance of this legalisation, the state has provided legal certainty regarding the valid management; therefore, all activities conducted in the name of these foundations must be carried out by parties possessing the legality as recorded in the Legal Entity Administration System (SABH) of the Ministry of Law.
Legal counsel for UIN Syarif Hidayatullah Jakarta, Alwanih, emphasised that no parties should henceforth claim, use the name of, or act on behalf of the foundations, nor occupy state assets without a valid legal basis. She stated that the state has determined and authorised the legitimate board of trustees and management through the Ministry of Law’s AHU.
“Therefore, there must no longer be any parties acting in the name of the foundations outside of the authorised management. This legal certainty must be respected by all parties,” said Alwanih. She added that the AHU legalisation is not merely an administrative document, but a form of official state recognition of the foundations’ management legality. Every action taken on behalf of the foundations must refer to the management that has obtained such authorisation. Alwanih further explained that the use of the foundation’s name by unauthorised parties could lead to legal consequences.
