Jakarta – Two defendants in an alleged fictional procurement case involving a housing project in 2022–2023, Herry Nurdy Nasution and Didik Mardiyanto, have been sentenced to 3 years and 5 years imprisonment respectively.

The prosecutor from the Corruption Eradication Commission (KPK), Irwan Ashadi, is confident that both defendants have been proven guilty beyond reasonable doubt of committing corruption offences jointly and unlawfully.

“Committing acts to enrich themselves or others or a corporation that harm state finances or the national economy,” stated the prosecutor during the reading of the indictment at the Corruption Court at the Central Jakarta District Court on Friday, 27 February 2026.

Should the seizure and sale of assets or income prove insufficient or impossible to implement, unpaid fines will be replaced (subsidiary) with imprisonment for 80 days.

Furthermore, the prosecutor also sought additional punishment in the form of restitution payments. Herry has been ordered to pay restitution of IDR 10.8 billion, reduced by the amount already returned, such that Herry is no longer burdened with restitution payment.

The prosecutor believes both defendants violated Article 603 in conjunction with Article 20 (c) in conjunction with Article 126 (1) of the National Criminal Code in conjunction with Article 18 of Law No. 31 of 1999 on the Eradication of Corruption Offences as amended and supplemented by Law No. 20 of 2001, as per the first alternative charge.

Aggravating circumstances include that both defendants have not supported the government programme for combating corruption offences. Mitigating factors considered include that the defendants have no prior criminal convictions.

In this case, both defendants allegedly caused state losses of IDR 46.8 billion through enriching themselves or others or a corporation. The fictional procurement allegedly occurred on housing development projects, including the construction of a ferronickel smelter in Kolaka Regency, South-East Sulawesi.

Additionally, the Mines of Bahodopi Block 2 and 3 project for PT Vale Indonesia Tbk in Morowali Regency, Central Sulawesi, the Sulut-1 Coal FSPP, FSPP Portsite, Mobile Power Plant Packages 7 and 8, Bangkanai GEPP 140MW 0, and the Manyar Power Line projects.

The fictional procurement allegedly enriched several parties: Didik by IDR 35.33 billion, Herry by IDR 10.8 billion, and PT Adipati Wijaya Director Imam Ristianto by IDR 707 million.
