Two Defendants in Bank Branch Manager Murder Dismissed from TNI and Ordered to Pay Rp 1.2 Billion Restitution
The Jakarta Military Court panel has imposed additional penalties of dismissal from the TNI and restitution against two of the three defendants involved in the murder of bank branch manager M. Ilham Pradipta. The two defendants are Serka Mochamad Nasir and Kopda Feri Herianto.
The verdict session was held at the Military Court in East Jakarta on Wednesday (3/6/202pend). The prison sentences for the defendants are as follows:
Serka Mochamad Nasir: 13 years imprisonment
Kopda Feri Herianto: 7 years imprisonment
Serka Frengky Yaru: 1 year imprisonment.
The judge subsequently read the additional penalties for Nasir and Feri, both of whom are to be dismissed from military service. “Additional penalty: dismissal from military service,” stated the chairman of the judicial panel, Colonel Chk Fredy Ferdian Isnartanto, while reading the verdict.
Both individuals are also required to pay restitution, or compensation, to the family of the late M. Ilham Pradipta. The total restitution to be paid amounts to Rp 1.2 billion.
“Sentencing Defendant I to pay restitution to the family of the late Muhammad Ilham Pradipta in the amount of Rp 750 million, no later than 30 days after Defendant I receives a legally binding decision,” said Colonel Chk Fredy.
“Sentencing Defendant II to pay restitution to the family of the late M. Ilham Pradipta in the amount of Rp 500 million, no later than 30 days after Defendant II receives a legally binding decision,” he added.
Should the two defendants fail to pay the restitution, their assets will be seized and auctioned. If the assets are insufficient, they will face additional prison terms of 7 months and 5 months, respectively.
The judge ruled that Defendant I, Nasir, was proven to have murdered the victim, while Defendant II, Feri, and Defendant III, Frengky, were proven to have kidnapped the victim. The judge stated that the defendants’ actions were extremely cruel, leaving deep trauma for Ilham’s family, and further noted that their actions damaged the reputation of the TNI.
