Trade Ministry Revises E-Commerce Regulation, Platforms Required to Be Transparent on Fees
The Ministry of Trade (Kemendag) is targeting the completion of revisions to Trade Ministerial Regulation (Permendag) Number 31 on Trading Through Electronic Systems (PMSE) next week. One of the main points in the revision of the regulation is the obligation for e-commerce platforms to be more transparent about the fees charged to sellers. “Kemendag is currently revising Permendag Number 31 PMSE. Hopefully, it will be finalised now, hopefully completed next week,” said Trade Minister Budi Santoso after inspecting food prices and supplies at Palmerah Market, Jakarta, on Wednesday (13/5/2026). “Platforms must be transparent in imposing fees, admin fees or any other fees must be transparent and there must be an agreement that can be downloaded on the platform,” he stated. Kemendag also wants to create a more equitable relationship between sellers and platforms in the digital trading ecosystem. “Sellers and platforms must be equal. They have respective rights and obligations. Likewise, consumers must be protected,” he said. In addition to fee transparency, the PMSE regulation revision also regulates the obligation for platforms to provide complaint services with a clear service level agreement (SLA). The service is prepared to protect the interests of consumers and sellers if problems occur in digital transactions. Budi added that the PMSE regulation revision was prepared together with the Ministry of SMEs so that the policies issued complement each other and do not overlap. “They complement each other, we always coordinate with the Minister,” Budi revealed. Previously, Kemendag stated that the revision of Permendag Number 31 of 2023 was carried out to strengthen protection for local products and SMEs, consumer protection, and priority promotion of domestic products on e-commerce platforms. Evaluation of the PMSE regulation was conducted in line with the increasing digital trading activities and strengthening supervision of the electronic system-based trading ecosystem.
