Jakarta (ANTARA) - The continuation hearing for the alleged kidnapping and murder of a bank branch head (kacab) in Jakarta, initialled MIP (37), is being held again on Wednesday morning at the Military Court II-08 Jakarta.

The hearing is scheduled with the agenda of reading the response to the objection note (exceptions) from the defendants’ legal team.

“The plan for the morning is as usual, waiting for the readiness and completeness of all parties,” said the Spokesperson for the Military Court II-08 Jakarta, Lieutenant Colonel (Law) Arin Fauzam, when contacted by ANTARA in Jakarta on Wednesday.

The defendants, namely Serka MN (defendant 1), Kopda FH (defendant 2), and Serka FY (defendant 3), are accused of being involved in a series of kidnappings accompanied by the murder of MIP.

Arin confirmed that today focuses on the official response from the military prosecutor to the exceptions previously submitted by the defence.

The hearing is scheduled for the morning, around 09:00, in the Garuda Courtroom or the main courtroom, with the main agenda being to hear the response from the military prosecutor.

This stage is an important part before the panel of judges determines its stance on the submitted exceptions.

“So today it’s the prosecutor’s response to the exceptions, in the morning,” said Arin.

Arin stated that this hearing has not yet entered the substantive examination stage of the case, including presenting witnesses.

The panel of judges will first decide whether the submitted exceptions are accepted or rejected through an interim ruling.

“Not yet, the interim ruling first, whether the exceptions are accepted or rejected,” said Arin.

For information, exceptions are an objection note submitted by the defendant or their legal counsel against the charges presented by the prosecutor.

If the exceptions are accepted, the case could be stopped or returned for correction.

However, if rejected, the trial will proceed to the proof stage with the presentation of witnesses and evidence.

Based on the Case Tracking Information System (SIPP) page of the Military Court II-08 Jakarta, the hearing falls under the murder case type with case number 52-K/PM.II-08/AD/III/2026.

Arin also urged media colleagues to monitor and follow the course of the trial.

In the hearing, the Military Prosecutor, acting as the public prosecutor in the military court, will present the three defendants directly to the Military Court II-08 Jakarta.

Arin also guaranteed that the trial process will be conducted professionally, independently, impartially, transparently, and accountably.

Details of the Charges

Previously, three Indonesian Army (AD) personnel were charged with premeditated murder in the alleged kidnapping and murder case of a bank branch head (kacab) in Jakarta initialled MIP (37).

“We have charged the three defendants in the alleged kidnapping and murder case of the bank branch head initialled MIP. We used combined charges so they do not escape our charges,” said Military Prosecutor Colonel Chk Andri Wijaya in the first hearing of the alleged kidnapping and murder case of the bank branch head at the Military Court II-08 Jakarta, Cakung, East Jakarta, on Monday (6/4).

In the trial, the military prosecutor emphasised that they used a combined charge construction that includes primary, subsidiary, more subsidiary, alternative, and cumulative charges.

The main charge submitted is Article 340 of the Criminal Code on premeditated murder. In this construction, the defendants are alleged to have planned the action in advance that resulted in the loss of the victim’s life.

The prosecutor also prepared other layers of charges as anticipation if the elements of premeditated murder cannot be proven perfectly in the trial.

“If premeditated murder does not meet the elements, we will prove it with the subsidiary article, namely Article 338 of the Criminal Code on Murder. Even more subsidiary, Article 351 paragraph 3 regarding assault causing death,” explained Andri.

In addition, the prosecutor also submitted alternative charges under Article 333 paragraph 3 of the Criminal Code regarding deprivation of liberty causing death.

This charge relates to allegations of kidnapping or unlawful detention of the victim before death.

The defendants are also subject to cumulative charges under Article 181 of the Criminal Code, which regulates the act of concealing a body.

This article indicates allegations of efforts to eliminate traces or obscure facts after the victim’s death incident.

“We accumulate with Article 181 on concealing a body. This is part of the series of actions that we consider interconnected,” said Andri.

Based on the chronology, a bank branch head (kacab) assistant initialled MIP is alleged to have been the victim of kidnapping and murder at one of the shopping centres in Ciracas, East Jakarta, on 20 August 2025.

The body was found in Kampung Karangsambung, RT 8/RW 4, Nagasari Village, Serang Baru Subdistrict, Bekasi Regency, West Java, around 05:30 WIB, on 21 August 2025.

A resident in the rice field area first found the body with hands and feet bound, and eyes covered with duct tape.

The body was immediately taken to Kramat Jati Police Hospital for autopsy as part of the investigation.
