Today's Hearing Examines Witnesses in Jakarta Bank Branch Manager Case
Jakarta (ANTARA) - The Military Court II-08 Jakarta is holding a continuation hearing today in the case of the alleged kidnapping and murder of a bank branch head in Jakarta with initials MIP (37), with the agenda being the examination of witnesses.
“Today’s witness examination hearing will be held in the morning as usual, if all parties are complete,” said the Spokesperson for the Military Court II-08 Jakarta, Lieutenant Commander (Legal) Arin Fauzam, when contacted by ANTARA in Jakarta on Monday.
The defendants, namely Serka MN (defendant 1), Kopda FH (defendant 2), and Serka FY (defendant 3), are accused of being involved in a series of kidnappings accompanied by the murder of MIP.
Arin assured that today the focus is on examining witnesses to reveal the legal facts underlying the case. From a total of 17 witnesses prepared, the summons will be carried out gradually.
The strategy of summoning witnesses gradually is carried out to maintain the effectiveness and smoothness of the trial process, considering the large number of witnesses and the complexity of the case being handled.
“Planned to examine seven witnesses, but it’s not yet known who will attend,” said Arin.
The hearing is scheduled to take place in the morning, around 10:00, in the Garuda Courtroom or the main courtroom.
“Hereby declares to reject the objections submitted by the defendants and the defendants’ legal advisors,” said Presiding Judge Colonel Chk Fredy Ferdian Isnartanto in the reading of the interim decision at the Military Court II-08 Jakarta, Cakung, East Jakarta, on Wednesday (15/4).
In its decision, the panel of judges stated that the objections submitted cannot be accepted and are not legally based.
Referring to Article 145 Paragraph (2) of Law Number 31 of 1997 concerning Military Justice, the panel decided that the trial of the case must continue.
The military prosecutor uses a combined indictment construction that includes primary, subsidiary, more subsidiary, alternative, to cumulative charges against the defendants.
The main charge submitted is Article 340 of the Criminal Code on premeditated murder. In this construction, the defendants are alleged to have planned the action in advance that resulted in the loss of the victim’s life.
The prosecutor also prepares other layers of charges in anticipation if the elements of premeditated murder cannot be proven perfectly in the trial, namely the subsidiary article, namely Article 338 of the Criminal Code on murder subsidiary to Article 351 paragraph 3 regarding assault causing death.
In addition, the prosecutor also submits alternative charges in the form of Article 333 paragraph 3 of the Criminal Code regarding deprivation of liberty causing death.
This charge relates to allegations of kidnapping or unlawful detention of the victim before death.
The defendants are also subject to cumulative charges under Article 181 of the Criminal Code, which regulates the act of concealing a body. This article indicates an alleged attempt to eliminate traces or obscure facts after the victim’s death incident.
