Today, Exception Hearing for Three Defendants in Bank Branch Manager Murder Case in Jakarta
Jakarta (ANTARA) - The continuation hearing for the reading of the objection note or exception from the defence side in the alleged kidnapping and murder case against a bank branch head (kacab) with initials MIP (37) is being held today at the Military Court II-08 Jakarta.
“Yes, it’s happening today; this morning, the reading of the objection note or exception from the defendants against the charges presented by the military prosecutor,” said the Spokesperson for Military Court II-08 Jakarta, Lieutenant Colonel (Law) Arin Fauzam, when contacted by ANTARA in Jakarta on Monday.
The defendants, namely Serka MN (defendant 1), Kopda FH (defendant 2), and Serka FY (defendant 3), are charged with involvement in a series of kidnappings accompanied by the murder of MIP.
The hearing with the exception agenda is scheduled to take place around 09:00 WIB in the Garuda Courtroom or the main courtroom.
“Planned for 09:00 WIB, depending on the situation and conditions, waiting for the parties. If everyone is present, the hearing can start,” said Arin.
Arin emphasised that in today’s hearing, the panel of judges will only listen to the reading of the exceptions from the legal advisory team of the three defendants. Thus, there is no agenda for witness examination in this session.
“Today’s agenda is just the exception,” Arin stressed.
An exception can be filed if there is inconsistency in the description of the charges or if the defendant considers there to be a fundamental error, such as an error regarding the person (error in persona) or issues of court jurisdiction.
Through this exception, the defence can challenge the validity of the charges before entering the proof stage.
This case has attracted public attention because it involves allegations of serious criminal acts, namely kidnapping and murder of a bank branch head.
The panel of judges will later consider the content of the exception before deciding whether the charges can proceed to the proof stage or not.
If the exception is rejected, the hearing will continue with the agenda of witness examination and proof.
Based on the Case Search Information System (SIPP) page of Military Court II-08 Jakarta, the hearing falls under the type of murder case with case number 52-K/PM.II-08/AD/III/2026.
Arin also urged media colleagues to monitor and follow the course of the trial.
In the hearing, the Military Prosecutor, acting as the public prosecutor in the military court, will present the three defendants directly to Military Court II-08 Jakarta.
Details of the Charges
Previously, three Indonesian Army (AD) personnel were charged with premeditated murder in the alleged kidnapping and murder case against a bank branch head (kacab) in Jakarta with initials MIP (37).
“We have charged the three defendants in the alleged kidnapping and murder case against the bank branch head with initials MIP. We used combined charges so they cannot escape our charges,” said Military Prosecutor Colonel Chk Andri Wijaya in the first hearing of the alleged kidnapping and murder case against the bank branch head at Military Court II-08 Jakarta, Cakung, East Jakarta, on Monday (6/4).
In the trial, the military prosecutor emphasised that they used a combined charge construction that includes primary, subsidiary, more subsidiary, alternative, and cumulative charges.
The main charge submitted is Article 340 of the Criminal Code on premeditated murder. In this construction, the defendants are alleged to have planned the actions in advance that resulted in the loss of the victim’s life.
In addition, the defendants are also subject to cumulative charges under Article 181 of the Criminal Code, which regulates the act of concealing a corpse.
