Thai Firm Gentlewoman Wins Trademark Dispute at Central Jakarta District Court
Thai company Gentlewoman Co Ltd has won a trademark infringement lawsuit at the Central Jakarta District Court (PN Jakpus) concerning the use of the “Gentlewoman” mark.
The court partially granted Gentlewoman’s claims against defendant Wifina Lauw. According to the District Court’s judicial case system (SIPP), the case was registered on Monday 9 March 2026 under case number 107/Pdt.Sus-HKI/Merek/2025/PN Niaga Jkt.Pst, with Gentlewoman Co Ltd as plaintiff and Wifina Lauw as defendant.
The court’s key rulings were as follows:
The court rejected the defendant’s exceptions in their entirety and partially granted the plaintiff’s primary claims, including:
Declaring that the Gentlewoman mark owned by the plaintiff constitutes a well-known trademark;
Declaring that the Gentlewoman marks registered under numbers IDM001135036 (30 October 2023, class 18), IDM001137448 (8 November 2023, class 25), and IDM001315527 (24 March 2025, class 35), all registered in the defendant’s name, share fundamental and overall similarity with the plaintiff’s Gentlewoman mark;
Declaring that these three registrations share fundamental and overall similarity with the plaintiff’s corporate name, Gentlewoman Co., Ltd.;
Finding that all three Gentlewoman trademark registrations were registered in bad faith;
Declaring these three trademark registrations null and void in law, effective from the judgment date;
Ordering the co-defendant (the Indonesian Minister of Law and Human Rights through the Directorate General of Intellectual Property and the Directorate of Trademarks and Geographical Indications) to cancel the three Gentlewoman trademark registrations registered in the defendant’s name, effective from the judgment date;
Rejecting other plaintiff claims;
Ordering both the defendant and co-defendant to comply with and execute all provisions of this judgment;
Rejecting the defendant’s counter-claim in its entirety;
Ordering the defendant to pay court costs of Rp 446,000.
According to Indonesia’s Intellectual Property Database, several Gentlewoman marks are registered. Gentlewoman Co Ltd, the Thai company, registered various Gentlewoman marks across different classes for goods including hair accessories, spectacles, perfume, clothing, bags, and wallets. The marks bear the word “GENTLEWOMAN” in various designs.
Additionally, the database contains Gentlewoman marks with a framed letter G logo alongside “GENTLEWOMAN” and “FLAWLESS BEAUTY” text, and another mark featuring a bag logo with “GW” and “GENTLEWOMAN” inscriptions. These latter marks are owned by Wifina Lauw.
In its lawsuit, Gentlewoman Co Ltd sought a court declaration that its Gentlewoman mark constitutes a well-known trademark and requested the cancellation of all Gentlewoman trademark registrations belonging to Wifina Lauw.
