TAUD Files Pre-Trial Motion in Andrie Yunus Case at South Jakarta District Court

The Advocacy Team for Democracy (TAUD) has filed a pre-trial motion at the South Jakarta District Court (PN Jaksel) concerning the acid attack on KontraS activist Andrie Yunus by TNI members.

“Today, we have registered the pre-trial application. In this application, we are naming the Metro Jaya Police Chief and the Director of General Criminal Investigation at Metro Jaya Police as respondents in this case,” said legal representative Alif Fauzi Nurwidiastomo, as quoted by Antara on Wednesday (29/4).

Alif, representing Andrie Yunus, stated that the application was filed because the investigation process from the Model A Police Report was deemed stalled or deadlocked. His side assessed that there had been no developments or follow-up in the law enforcement process for the case.

Alif said that no termination of investigation order (SP3) had been issued by the police investigators after the case file was handed over to the TNI Military Police Centre (Puspom) investigators.

“Because the latest information is that the investigators from the Directorate of General Criminal Investigation at Metro Jaya Police have handed over or transferred the case file and evidence to the investigators at the TNI Puspom,” Alif stated.

He mentioned that based on the provisions in the Criminal Procedure Code (KUHAP), if there is civilian involvement, the case handling should be conducted through the mechanism of general courts or connexity.

Moreover, his side assessed that the mechanism of transferring cases between institutions is not recognised in the KUHAP, so the investigation by Metro Jaya Police should continue.

Therefore, Alif emphasised that through this pre-trial application, his side is requesting that the investigators resume the investigation process for the case affecting his client.

“The request in this application is that the Metro Jaya Police investigators must continue their investigation process,” Alif said.

Furthermore, his side also rejects the handling of the case currently proceeding in the military court.

According to Alif, the case not only involves the perpetrators currently on trial but is also suspected to involve more parties.

“We believe this was not purely carried out by the four individuals now on trial. Our findings indicate 16 perpetrators in the field, not including intellectual actors or possible civilian perpetrators,” Alif revealed.

Previously, he said, the legal team had also attended a clarification invitation from the investigators on Tuesday (28/4), bringing additional evidence, including the results of an independent investigation by the Advocacy Team for Democracy (TAUD).

“We submitted various pieces of evidence, from investigation reports, written documents, to statements from public officials, including the President’s statement in an interview with journalists,” Alif said.

Currently, there are two reports running at Metro Jaya Police, namely the Model A Police Report created by the police and the Model B Police Report previously reported to the National Police Criminal Investigation Agency (Bareskrim Polri), then transferred to Metro Jaya Police.
