TaniHub Entities Face Billions in Fines After Corruption Verdict

Public prosecutors have demanded that three corporations within the TaniHub group each pay a fine of Rp1 billion in connection with a proven case of investment corruption involving PT BVI and PT MDI Ventures. In addition to the fines, the three companies are also required to pay restitution totalling Rp359.9 billion.

The demands were read by Prosecutor Dicky Haris during a session at the Corruption Court at the Central Jakarta District Court on Monday. The three corporate defendants are PT Tani Group Indonesia (PT TGI), PT TaniHub Indonesia (PT THI), and PT Tani Supply Indonesia (PT TSI).

In his ruling, the prosecutor stated that the three corporations were legally and convincingly proven to have jointly committed corruption. The prosecutor emphasised that there were no justifiable or excusable reasons to absolve the defendants of criminal liability, as the acts were committed consciously and deliberately.

“Based on factual and juridical analysis, we conclude that the corporate defendants PT TGI, PT THI, and PT TSI have been legally and convincingly proven guilty of jointly committing corruption,” said Prosecutor Dicky Haris in court.

An aggravating factor in the demands is that the defendants’ actions were deemed not to support the government’s programme to eradicate corruption, collusion, and nepotism. Furthermore, the case resulted in state financial losses amounting to 25 million US dollars, equivalent to Rp364.22 billion.

The prosecutor believes the three corporations violated Article 603 in conjunction with Article 18 of the Corruption Eradication Law, in conjunction with Article 618 in conjunction with Article 20 letter c of Law Number 1 of 2023 concerning the Criminal Code. Previously, six individual defendants in the same case were found guilty by the panel of judges.
