The Surabaya District Court panel of judges has handed down a four-month prison sentence to Moh Syifak. The judge ruled that Syifak was proven to have broken into a motorcycle seat and stolen 5,000 rupiah (locally known as ‘goceng’).

According to reports, the sentence was delivered after attempts to resolve the case through restorative justice failed. The panel of judges declared Syifak guilty of aggravated theft.

The verdict aligns with the prosecution’s demand. In the ruling, the judge stated that Syifak was proven legally and convincingly guilty as regulated under Article 477, paragraph (1), point f of Law Number 1 of 2023 concerning the Criminal Code.

“Adjudicating, declaring the Defendant Moh Syifak bin Muntiri has been proven legally and convincingly guilty of committing the crime of theft under aggravating circumstances. Therefore, the court imposes a prison sentence of 4 months on the Defendant,” stated the presiding judge, Erly Soelistyarini.

The case began when Syifak broke into the seat of a Honda Vario motorcycle belonging to Dicky Prasetya on Saturday (22/4) at approximately 00:30 WIB. The judge ruled that the defendant’s actions were unjustifiable as they involved damaging the victim’s motorcycle seat.

“By forcibly opening the seat with his bare hands, the defendant took one black Weekend Teror brand bag containing one black Lacoste brand wallet and 5,000 rupiah in cash, all of which belonged to the witness Dicky Prasetya,” the judge added.
