Surabaya Hit-and-Run Suspect Faces Up to Six Years in Prison
Surabaya City Police have formally charged ENR (32), the suspect in a fatal hit-and-run case in central Surabaya, with multiple offences. He faces a maximum sentence of six years in prison after driving under the influence of alcohol and causing the death of one person.
Head of the Traffic Accident Unit at Surabaya City Police, First Inspector Sulthon NA, explained that the layered charges were based on the suspect’s negligence, which proved fatal, as well as his deliberate attempt to flee the scene.
Police have charged ENR under Article 310 paragraph (4) of Law Number 22 of 2009 on Road Traffic and Transportation, which stipulates sanctions for drivers whose negligence causes a traffic accident resulting in death. ENR is also charged under Article 106 paragraph (1) of the same law, which requires every person to drive their vehicle reasonably and with full concentration.
“We have charged the perpetrator under Article 310 paragraph (4) in conjunction with Article 106 paragraph (1),” Sulthon said at the Surabaya City Police Traffic Unit office on Monday (24/8).
ENR is also charged under Article 312 in conjunction with Article 231 of Law Number 22 of 2009, which regulates criminal penalties for hit-and-run offenders. Sulthon said the maximum sentence ENR could face is six years in prison.
“With a maximum penalty of six years in prison. We have applied Article 312 in conjunction with Article 231 because at the time of the incident the person concerned fled,” he said.
The layered charges are further supported by findings of other serious violations at the scene. Police stated that the suspect was not only driving while intoxicated but was also proven not to be carrying complete driving documents.
“At the scene, no vehicle registration certificate or driving licence was found,” he said.
Based on physical examination at the scene, officers confirmed that ENR was under the influence of alcohol at a very high level shortly before the series of collisions occurred.
“In our examination, we carried out a breathalyser test and the result was positive for alcohol. However, a urine test for narcotics showed no substances. The breathalyser test showed an alcohol level of 1.06 per cent, which exceeds the normal limit,” he said.
Sulthon said police are taking a firm stance in handling this case. He confirmed that the investigation and legal process will continue professionally, even if the suspect shows good faith towards the victim’s family in the future.
“The legal process continues, and detention has been carried out. It remains in effect. He has now been named a suspect and is detained,” he said.
As previously reported, the series of collisions occurred in the area of Jalan Gubernur Suryo and Jalan Taman Apsari, Surabaya, not far from Grahadi State Building, in the early hours of Sunday (23/8). The incident was triggered by a driver under the influence of alcohol, resulting in one fatality.
The accident occurred at around 3.30 a.m. local time, beginning when a Mitsubishi Outlander with registration number L 1049 OO driven by ENR (32) was travelling from Jalan Taman Apsari.
ENR is suspected of driving while intoxicated due to alcohol consumption. He lost concentration and collided with an electric taxi with registration number L 1611 UG driven by FDK (22) while it was parked.
After hitting the first vehicle, ENR did not stop and continued driving away from the scene towards Jalan Gubernur Suryo, right next to Surabaya City Square.
At the second location, the car driven by ENR struck RPK (25), who was loading goods into a parked L300 pick-up truck with registration number L 9760 CJ.
As a result of the impact, RPK suffered serious injuries and was immediately taken to the Emergency Unit of Dr Soetomo Regional General Hospital in Surabaya. The victim’s life could not be saved and he was pronounced dead while undergoing medical treatment.
