Supreme Court Increases Sentence for Former Budget Director General Isa to Two Years

The Supreme Court (MA) has increased the sentence for former Director General of Budget at the Ministry of Finance, Isa Rachmatarwata, in the PT Asuransi Jiwasraya corruption case from one year and six months’ imprisonment to two years. In addition to increasing the prison term, the MA also raised the fine from Rp100 million to Rp200 million, with a subsidiary of 80 days’ confinement. “Reject the appeal. Reject the cassation of the public prosecutor and the defendant with the amendment of a two-year prison sentence and a fine of Rp200 million, subsidiary to 80 days’ imprisonment,” read the MA ruling quoted from the court’s registry page in Jakarta on Thursday. The cassation decision was handed down by a panel of judges chaired by Yanto, with members Anshori and Achmad Setyo Pudjoharsoyo. Through this ruling, the MA amended the Jakarta High Court’s appeal decision, which had upheld the Jakarta Central District Court Corruption Court’s verdict of one year and six months’ imprisonment and a fine of Rp100 million. In this case, Isa was found guilty of committing a criminal act of corruption jointly, as charged in the subsidiary indictment, and was declared to have violated Article 3 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption, as amended by Law Number 20 of 2001, in conjunction with Article 55 paragraph (1) 1 of the Criminal Code. Isa was accused of causing state losses amounting to Rp90 billion in the alleged corruption case involving the financial and investment management of PT Asuransi Jiwasraya for the period 2008–2018. According to the indictment, the losses occurred after Isa, in his capacity as Head of the Insurance Bureau at the Capital Market and Financial Institutions Supervisory Agency (Bapepam-LK) for the 2006–2012 period, approved insurance products when Jiwasraya’s financial condition had already deteriorated. The act was allegedly committed together with Hendrisman Rahim, Hary Prasetyo, and Syahmirwan, and enriched Provident Capital Ltd. by Rp50 billion and Best Meridian Insurance Company by Rp40 billion.
