Student Clash Results in Death, Ministry of Women's Empowerment and Child Protection Monitors School Guidance
Jakarta (ANTARA) - The Ministry of Women’s Empowerment and Child Protection (KemenPPPA) continues to monitor the handling of the case involving the death of a student in an inter-student clash in Bandung, West Java.
“Guidance for schools is scheduled after the holiday,” said Acting Deputy for Special Child Protection at KemenPPPA, Indra Gunawan, when contacted in Jakarta on Friday.
According to him, KemenPPPA continues to coordinate with the Head of the West Java Provincial Education Office and the Head of the Bandung City Women’s Empowerment and Child Protection Office regarding this case.
Meanwhile, the Bandung Metropolitan Police Resort is still investigating the case, including allegations of assault against the victim.
KemenPPPA hopes the police can uncover this case.
“Because the suspected cause of the victim’s death is assault, such actions potentially violate Article 76C in conjunction with Article 80 paragraph (1) of Law Number 35 of 2014 on Child Protection,” said Indra Gunawan.
In addition, if the violence is carried out collectively in public and results in the victim’s death, provisions of Article 262 paragraph (4) of the Criminal Code may apply, with a maximum prison sentence of 12 years.
If it is discovered during the legal process that the alleged perpetrators are still minors, the case handling must adhere to Law Number 11 of 2012 on the Juvenile Criminal Justice System (SPPA), while prioritising child protection principles and a restorative justice approach.
Previously, FA (17), a student at SMAN 5 Bandung, died on Jalan Cihampelas in Bandung, West Java, on Friday night (13/3).
The incident that resulted in the victim’s death occurred after the victim attended an iftar gathering event.
