The State Secretariat (Kemensetneg) and the Gelora Bung Karno Complex Management (PPKGBK) have broken their silence regarding a lawsuit filed by a man claiming to be the rightful heir to the land on which Hotel Sultan stands. The lawsuit, registered under case number 411/Pdt.G/2026 at the Central Jakarta District Court, was filed by Raden Mas (RM) Kusrahardjo, who claims to be the heir of RM Koesen. He asserts that the land occupied by Hotel Sultan is part of his family’s property, based on an Eigendom Verponding Number 1684 issued in 1938, covering an area of 420,500 square metres. The plaintiff is suing six parties, including the State Secretariat, the Ministry of Finance, and PPKGBK, seeking the cancellation of existing land certificates and demanding compensation.

Kharis Sucipto, the legal representative for both PPKGBK and the State Secretariat, stated that the core of the lawsuit questions the ownership rights of the Hotel Sultan land. The plaintiff claims that a portion of the land covered by the colonial-era Eigendom Verponding was used by PT Indobuildco to construct the hotel. Consequently, the lawsuit demands that the court annul the building rights titles (HGB) No. 26 and No. 27 held by PT Indobuildco and remove them from the state’s Management Rights (HPL) No. 1/Gelora. The plaintiff is also seeking material damages of approximately Rp14 trillion and additional material losses of Rp500 billion.

However, Kharis emphasised that the government’s position is that the land in question was legally acquired long ago. He explained that based on documents held by the Gelora Bung Karno complex and the State Secretariat, the land corresponding to the former HGB 26 and HGB 27 was fully acquired and compensated by the government between 1959 and 1962 for the purpose of hosting the Asian Games. After the land was cleared, a portion of the HPL No. 1/Gelora area was granted to PT Indobuildco with government permission to construct a building. Kharis further noted that the government’s archives do not show any record of the disputed Eigendom Verponding Number 1684 on the specific plots of land in question. He affirmed that the legal validity of HPL No. 1/Gelora has been tested and upheld in numerous court decisions with permanent legal force, both in civil and administrative cases.
