State legislation on PKI members

Sept. 30, 1965 - Blames attempted coup d'etat on PKI

1966 - Emergency People's Consultative Assembly

(MPRS) issues MPRS Decree No. 25/1966

outlawing PKI as a political party, any

activities disseminating or developing

Communist, Marxist or Leninist teachings and

ideologies in Indonesia

- Punishes, incarcerates or exiles members or

alleged members of PKI and affiliate

organizations, either legally or

extrajudicially

- Stamps ID cards of those jailed or exiled

E.T. for ex tapol, or political detainee

1976 - Government Decree No. 6/1976 bans members of

PKI and affiliate organizations from civil and

military services

1980 - Operational Command for the Restoration of

Security and Order (Kopkamtib) issues decree

to implement 1976 Government Decree

1981 - Home minister issues Instruction No. 32/1981

to all government institutions on how "to

handle" PKI members and their relatives, such

as requiring them to report to the nearest

military command upon relocation

1982 - Kopkamtib commander issues Guideline No.

15/1982 on ideological screening for civil

servants and employees of other vital

institutions or companies, either state- or

privately owned; screening includes background

checks on candidates' parents, parents-in-law,

siblings, aunts and uncles, grandparents and

spouses, as well as close friends, for ties to

PKI or affiliate organizations

1995 - Government Decree annuls E.T. stamp on IDs of

former prisoners/exiles implicated with PKI

1999 - House of Representatives issues Law No. 3/1999

on elections allowing former political

prisoners to vote, but retains ban on

legislative membership

2001 - President Abdurrahman "Gus Dur" Wahid makes

official apology for discrimination against

former members of PKI or its affiliates and

their families

- Politicians who fear revival of Communist

Party reject Gus Dur's idea to scrap 1966 MPRS

Decree

2003 - House of Representatives issues Law No.

12/2003 on legislative election retaining

ban on former members PKI or its affiliates

from polls

- House issues Law No. 23/2003 on presidential

election with same restriction

2004 - Constitutional Court annuls Article 60(g) of

Law No. 12/2003 on legislative election

banning former members of PKI or its

affiliates from legislature
