Spa Therapist Who Emptied Client's ATM of Rp1.2 Billion Faces Three-Year Prison Demand

Nur Hasannah, a spa therapist accused of stealing Rp1.28 billion from her client Tony Soegiono’s ATM, has been sentenced to three years in prison by the Public Prosecutor at the Surabaya District Court on Wednesday (24/6). Prosecutor Hasanuddin Tandilolo read the charges in Courtroom Sari 1 of the Surabaya District Court. In his indictment, the prosecutor stated that Nur Hasannah was legally and convincingly proven to have committed the crime of aggravated theft in accordance with the single charge of the public prosecutor. The prosecutor considered the defendant’s actions to fall into the category of aggravated theft, not merely a civil dispute, because it was carried out by repeatedly accessing the victim’s account using the victim Tonny’s ATM card and PIN number. The prosecutor also requested that the entire period of arrest and detention already served by the defendant be deducted from the total sentence imposed. After the charges were read, Chief Judge Purnomo Hadiyarto gave the defendant the opportunity to submit a defence statement. Nur Hasannah’s legal counsel, Zulfan Badrun Naja, immediately read it before the panel of judges. Zulfan considered that the prosecutor had drafted the charges rigidly and ignored facts revealed during the trial, including the spirit of restorative justice in this case. He claimed the victim, Tonny Soegiono, had forgiven his client and was willing to accept compensation in stages. His party also questioned the testimony of a factual witness named Solikin, the victim’s former driver, who claimed that part of his statement in the investigation report was the result of direction from the complainant, thus deeming it lacking strong evidentiary power. Zulfan also argued that the element of unlawful conduct was not fulfilled because the ATM card and PIN number were voluntarily handed over by the victim within their personal relationship. In her defence, Nur Hasannah also admitted to having a romantic relationship with the victim Tonny since around 2024. She claimed she was given the freedom to use the complainant’s debit card, even with the complainant’s knowledge during transactions. Nur Hasannah said this legal problem began after she asked to end the relationship. The complainant then demanded all the money used be returned. She claimed to have paid around Rp350 million in instalments, but the complainant no longer responded. The 26-year-old woman also appealed for humanitarian consideration. She stated she is a single mother with two children. The first child is still four years old, and the second child is eight months old and still requires breastfeeding. The legal counsel requested the panel of judges to acquit Nur Hasannah of all charges, or at least impose the lightest possible sentence in the form of a suspended sentence. ‘I deeply regret and realise that my actions have hurt several parties, including my family and my children,’ said Nur Hasannah, concluding her defence.
