Six North Sumatra Disnaker UPTs on standby to receive THR violation complaints
DISNAKER Sumut tightens supervision of THR payments ahead of Lebaran this year. As a concrete step, six UPTs are on standby to receive direct complaints from workers whose rights have not been fulfilled by their employers.
Head of the North Sumatra Department of Manpower (Disnaker Sumut), Yuliani Siregar, revealed that Disnaker Sumut and six UPTs have established THR complaint posts in their respective areas of work.
‘We have appointed a dedicated admin to manage complaints,’ she said on Thursday (5/3).
According to her, Disnaker Sumut guarantees every report submitted to the posts will be acted on promptly, whether via direct reports or through the online posko THR portal at poskothr.kemnaker.go.id.
Labour inspectors will be deployed to conduct on-site inspections at the companies named in the complaints. Inspectors will check the companies to determine the precise reasons THR was not paid.
This move is expected to maintain harmonious industrial relations in North Sumatra, while ensuring workers’ rights are fulfilled on time to enable a smooth religious holiday.
She stressed that all companies must pay THR no later than seven days before the religious holiday (H-7). This provision is binding under Permenaker No. 6 of 2016.
Under this regulation, companies that are late in paying THR will be fined 5% of the total THR that should have been paid. The fine will be used for the welfare of workers.
‘In addition to fines, administrative sanctions also await stubborn employers,’ she added.
Regarding THR amounts, she explained that workers with 12 months of service or more are entitled to THR equal to one month’s wage. For workers with at least one month but less than 12 months of service, THR is paid proportionally.
‘Calculation is: length of service multiplied by one month’s wage, then divided by twelve. However, if service is less than one month, the worker is not entitled to THR,’ she explained. (H-2)
