The Corruption Eradication Commission (KPK) has responded to the ruling by the South Jakarta District Court (PN Jaksel) which rejected the pre-trial motion filed by former Deputy Minister of Immigration and Correctional Services, Silmy Karim, concerning the forced seizure of assets. The KPK considers the judge’s decision to confirm that the asset seizure was legally valid.

“This strengthens the fact that the entire series of investigation processes conducted by the KPK, including the forced seizure of assets suspected to be related to, or allegedly purchased using, funds from suspected corruption, were all formally valid,” stated KPK Spokesperson Budi Prasetyo to journalists at the KPK Red and White Building, Kuningan, South Jakarta, on Tuesday (29/9/2026).

Budi stated that following this decision, the case will proceed with investigators. He mentioned that investigators will soon transfer the case files to the public prosecutor.

“Naturally, the material aspects will be tested in the Corruption Court. We will await the processes and stages. Currently, it is still in the investigation stage, and we are waiting as investigators are completing a few more details; the second stage of handover will be conducted soon,” Boded explained.

“Because the files will be complete very shortly. We will provide an update when the investigators and public prosecutors conduct stage II,” he concluded.

Previously, the judge rejected the pre-trial motion of former Deputy Minister of Immigration and Correctional Services Silmy Karim, ruling that the KPK’s designation of a suspect is valid.

“In the merits of the case, the court rejects the pre-trial petition submitted by the Petitioner in its entirety. The Petitioner is ordered to pay court costs in the amount of zero,” the judge stated during the pre-trial verdict hearing at the South Jakarta District Court on Tuesday (29/9).

In the considerations, the judge stated that the searches conducted by investigators were accompanied by search warrants, official reports of the search, and notifications to the KPK Supervisory Board. Investigators had also submitted a request for search approval to the Chief of the District Court.

“Considering that in conducting the search, the Respondent was equipped with a search warrant, an official report of the search was created, approval was obtained from the District Court, and notification was provided to the KPK Supervisory Board,” the judge explained.

The judge also noted that the scope of a pre-trial motion only pertains to the actions of investigators and does not extend to the actions of parties providing approval, such as the Chief of the District Court. The judge stated that the KPK investigators had fulfilled their obligations as stipulated by law.

“Factually, approval was issued by the Chief of the Court regarding the search; therefore, the search action must be declared valid,” he said.

Furthermore, the judge stated that the seizure conducted by investigators was based on a warrant, accompanied by an official report, and notified to the KPK Supervisory Board. Consequently, the seizure was declared valid.

“Thus, formally, the seizure is valid,” he said.
