Shifts in National Law Prompt West Java DPRD to Draft New Local Regulation
The Regional Regulation Formation Agency (Bapemperda) of the West Java DPRD considers the drafting of a Regional Regulation (Ranperda) on Procedures for the Formation of Regional Legal Products to be an urgent necessity. This follows fundamental changes in the national legal system that require regulatory adjustments at the regional level.
Bapemperda DPRD West Java member Tia Fitriani stated that the rules currently used as a reference for forming regional legal products still refer to West Java Provincial Regulation Number 3 of 2012, as amended by Regional Regulation Number 4 of 2015. According to her, these regulations are no longer able to accommodate the various legal developments that have occurred in recent years.
‘Both regulations have experienced a significant lag in norms due to drastic changes in the national legal landscape,’ Tia said while presenting Bapemperda’s views during a West Java DPRD plenary meeting in Bandung City, Tuesday (9/6/2026).
Tia explained that there are at least three waves of national legal changes forming the basis for the need to draft a new bylaw. First, the enactment of Law Number 13 of 2022 on the Formation of Legislation, which introduced the omnibus law method, mandates the harmonisation of draft regional regulations through the regional office of the Ministry of Law, and strengthens public participation through the concept of meaningful participation.
Second, the demand for digital transformation in the legislative process through the implementation of e-legislation, which allows all stages of regulation formation to be carried out electronically, from planning to promulgation. Third, the enactment of Law Number 1 of 2026 on Criminal Adjustments as a follow-up to the implementation of the national Criminal Code (KUHP), which changes the paradigm for formulating offences and criminal sanctions in regional regulations.
‘Based on these conditions, the required change is no longer an amendment, but a complete replacement by drafting a new regional regulation,’ she said. She stated that the Ranperda on Procedures for the Formation of Regional Legal Products will subsequently become the primary guide in the process of forming all regional legal products in West Java.
Through this initiative of the West Java DPRD, Bapemperda hopes that the discussion of the draft regulation will produce a comprehensive regulation that is adaptive to the times and able to answer the legal needs of the community. ‘This bylaw will later become a solid foundation for the birth of all quality, synergistic, and just regional legal products in West Java Province,’ Tia said.
