Jakarta (ANTARA) - Residents of City Park Apartment in Cengkareng, West Jakarta, will soon send a letter to the Mayor to summon the developer, PT RRAA, regarding the handover of apartment ownership documents in the form of the Building Use Rights Certificate (SHGB).

Chairman of the Flat Owners and Residents Association (PPPSRS), Stefanus Starly, said the letter is being submitted again because the developer skipped the scheduled handover event today, Thursday.

“Later, PPPSRS will send another letter to the Mayor of West Jakarta to request a summons regarding the handover process of ownership and social facilities-public facilities at City Park Rusunami,” Stefanus told reporters in Jakarta on Thursday.

He expressed regret over the developer’s attitude, which he deemed to show no good faith in fulfilling its obligations. He emphasised that the handover of documents is not merely optional but a mandatory obligation regulated by laws and regulations.

“This should no longer be a matter of willingness. After the units are sold and the PPPSRS is formed, the developer is obliged to hand over the documents, including the master certificate. This is already regulated in the law and related regulations,” Stefanus said.

According to him, various mediation efforts have been made, including those facilitated by the West Jakarta City Government. Even in previous meetings, the developer committed to handing over the documents on 2 April 2026.

“In fact, today they did not show up. This means not only we are not heard, but also the government. Previously, at the Mayor’s Office, they mediated and emphasised the handover obligation,” he said.

Stefanus added that this situation harms the residents, particularly in managing the master Building Use Rights Certificate (SHGB), which expires in 2028.

According to regulations, he said, the extension process must begin two years in advance, namely in 2026. He added that City Park Rusunami is built on land with SIPPT Number 1384/-1.711.534.

“The problem is, the master certificate is still held by the developer. Meanwhile, the residents have fulfilled their obligations. This is unfair because the residents’ rights are being held hostage,” he stressed.

He also emphasised that the majority of City Park Rusunami residents are middle to low-income people who greatly depend on legal certainty and civil rights over their homes.

“This is not a luxury apartment. This is a subsidised housing with around 3,600 units. We are only fighting for the rights of residents who have fulfilled their obligations,” he said.

PPPSRS, Stefanus continued, will still try a persuasive approach by inviting the developer again. However, if there is no response, they do not rule out taking legal action.

“We still prioritise good ways. But if residents’ rights continue to be held hostage, we will certainly take the necessary legal steps,” he stressed.

Previously, the developer skipped the handover of ownership and social facilities-public facilities (fasos-fasum) at City Park Apartment in Cengkareng, West Jakarta, on Thursday.

The developer’s absence delayed the handover of ownership rights in the form of the Building Use Rights Certificate (SHGB) to the residents and fasos-fasum to the West Jakarta City Government.

“Based on today’s meeting plan, the developer was scheduled to hand over fasos-fasum and ownership, but it could not proceed because the developer did not attend,” said Alexander Robet, an officer from the Level 1 Implementing Unit of the Integrated One-Stop Service (PTSP) in West Jakarta, to reporters in Jakarta on Thursday.

Alex stated that the developer did not respond despite being contacted by resident representatives.

“According to information from PPPSRS, they have been contacted but perhaps no response yet. The latest information is no response for attendance, but the invitation has been delivered,” he said.

The handover could not proceed even though Perum Perumnas was present. This was because the master SHGB is held by the developer.

Meanwhile, regarding the handover of fasos-fasum, Alex’s side continues to strive for the developer to fulfil its obligations.

The fasos-fasum in question includes road margins, parks, and others in accordance with the Land Use Designation Permit Letter (SIPPT).

“Usually, it’s road margins and parks. It will be seen in the SIPPT,” Alex concluded.
