Seven Defendants in OSH Certification Extortion Case Face Prison Sentences of 4.5 to 7 Years
A total of seven defendants in the case of extortion regarding the processing of Occupational Safety and Health (OSH) certificates are facing prison sentences of between 4.5 and 7 years. Prosecutors are convinced that the defendants are guilty of corruption in this case.
The sentencing hearing was held at the Jakarta Corruption Court on Monday (18/05/2026). Prosecutors believe the defendants have violated Article 12 letter b and Article 12 letter B in conjunction with Article 18 of the Anti-Corruption Law, as well as Article 20 letter c in conjunction with Article 127 paragraph 1 of Law Number 1 of 2023 regarding the Criminal Code.
“As the Public Prosecutors in this case, we demand that the Panel of Judges of the Corruption Court at the Central Jakarta District Court, which is examining and adjudicating this case, decide and declare that the Defendants have been proven legally and convincingly guilty of committing acts of corruption,” stated the prosecutor while reading the indictment.
The prosecution noted that the defendants’ actions do not support the government’s programme to realise a government free from collusion, corruption, and nepotism. Mitigating factors considered include the defendants’ lack of prior criminal records, their family responsibilities, and their polite conduct during the trial.
The full sentencing demands for the seven defendants are as follows:
Fahrurozi, former Director General of Binwasnaker and OSH (as of March 2025): Sentenced to 4.5 years in prison, a fine of Rp 250 million (subsidiary 90 days imprisonment), and restitution of Rp 233,018,441 (subsidiary 2 years imprisonment).
Hery Sutanto, Director of Institutional Development (2021 to February 2025): Sentenced to 7 years in prison, a fine of Rp 250 million (subsidiary 90 days imprisonment), and restitution of Rp 4,735,170,000 (subsidiary 2 years imprisonment).
Subhan, Sub-coordinator of Work Safety (2020-2025): Sentenced to 5.5 years in prison, a fine of Rp 250 million (subsidiary 90 days imprisonment), and restitution of Rp 5,802,058,952 (subsidiary 2 years imprisonment).
Gerry Aditya Herwanto Putra, Coordinator of the Field of Testing and Competency Evaluation of Work Safety (2022): Sentenced to 5.5 years in prison, a fine of Rp 250 million (subsidiary 90 days imprisonment), and restitution of Rp 13,262,341,634 (subsidiary 2 years imprisonment).
Sekarsari Kartika Putri, Sub-coordinator of the OSH Institutional Development Field at the Directorate General of Binwasnaker and OSH: Sentenced to 5.5 years in prison, a fine of Rp 250 million (subsidiary 90 days imprisonment), and restitution of Rp 42,678,740,086 (subsidiary 2 years imprisonment).
Anitasari Kusumawati, Sub-coordinator of Partnership and Occupational Health Personnel (2020): Sentenced to 5.5 years in prison, a fine of Rp 250 million (subsidiary 90 days imprisonment), and restitution of Rp 14,496,315,411 (subsidiary 2 years imprisonment).
Supriadi, Junior Expert Occupational Safety Inspector and Sub-coordinator of the OSH Personnel Empowerment Field at the Directorate General of Binwasnaker and OSH: Sentenced to 5.5 years in prison, a fine of Rp 250 million (subsidiary 90 days imprisonment), and restitution of Rp 19,812,796,902 (subsidiary 2 years imprisonment).
Previously, KPK prosecutors indicted the former Deputy Minister of Manpower, Immanuel Ebenezer Gerungan, also known as Noel, for extorting funds related to OSH certification alongside several civil servants from the Ministry of Manpower. Prosecutors alleged that Noel demanded a share of Rp 3 billion.
Prosecutors stated that the actions were carried out by Noel alongside other defendants, including Fahrurozi, Hery Sutanto, Subhan, Gerry Aditya Herwanto Putra, Irvian Bobby Mahendro, Sekarsari Kartika Putri, Anitasari Kusumawati, Supriadi, Miki Mahfud, and Termurila. The trial was held in a separate case file at the Central Jakarta Corruption Court on Monday (19/01).
“Has acted unlawfully or abused their power regarding the Issuance and Extension of Individual Occupational Safety and Health (OSH) Certifications/Licences for OSH certification/licence applicants,” the indictment against Noel stated.
In the indictment, prosecutors stated that the defendants coerced OSH certification and licence applicants to provide a total of Rp 6,522,360,000 (Rp 6.5 billion). This case has been ongoing since 2021, prior to Noel’s appointment as Deputy Minister of Manpower.
