Sentencing Hearing for Delpedro and Others in Incitement Case to be Held Tomorrow
The trial concerning the incitement case related to the protests that turned violent in August, with the defendants being Executive Director of Lokataru, Delpedro Marhaen, and others, will enter the sentencing phase. The sentencing hearing for Delpedro along with three other defendants will be held tomorrow.
“The hearing will resume on Friday, February 27, 2026, for the defendants to attend,” said the Chairman of the Panel of Judges, Harika Nova Yeri, at the Central Jakarta District Court, Thursday (February 26, 2026).
The other three defendants in this case are the administrator of @gejayanmemanggil, Syahdan Husein, staff of the Lokataru Foundation, Muzaffar, and a student from the University of Riau, Khariq Anhar. The judge had previously also changed the detention of Delpedro and others to house arrest for several reasons.
For information, Delpedro, Muzaffar, Syahdan, and Khariq were charged with incitement related to the protests that turned violent in August 2025. The prosecutor said that the incitement was carried out by Delpedro by uploading images and narratives on social media.
“Those who commit, order to commit, and those who participate in committing an act intentionally and without right distribute and/or transmit electronic information and/or electronic documents that are provocative in nature, invite, or influence others so as to cause feelings of hatred or hostility towards individuals and/or specific groups of people based on race, nationality, ethnicity, skin color, religion, belief, gender, mental disability or physical disability,” said the prosecutor while reading the indictment.
The prosecutor said that Delpedro, Muzaffar, Syahdan, and Khariq created or joined social media groups to establish intensive communication with parties who shared their views. The prosecutor said that the police found 80 content uploads that were considered provocative with the aim of inciting hatred towards the government on the Instagram social media platform, which were spread by Delpedro and others on August 24-29, 2025.
The prosecutor said that the consistent use of hashtags such as #indonesiagelap, #gejayanmemanggil, #bubarkandpr in all uploads created a unified campaign that was easily found and tracked by algorithms as a main topic. The prosecutor said that the uploads incited unrest at the end of August.
The prosecutor charged Delpedro, Muzaffar, Syahdan, and Khariq with violating Article 28 paragraph 2 in conjunction with Article 45A paragraph 2 or Article 28 paragraph 3 in conjunction with Article 45A paragraph 3 of Law Number 11 of 2008 concerning Information and Electronic Transactions in conjunction with Article 55 paragraph 1 clause 1 of the Criminal Code or Article 160 of the Criminal Code in conjunction with Article 55 paragraph 1 clause 1 of the Criminal Code or Article 76H in conjunction with Article 15 in conjunction with Article 87 of Law of the Republic of Indonesia Number 35 of 2014 concerning Child Protection in conjunction with Article 55 paragraph 1 clause 1 of the Criminal Code.
