Jakarta, VIVA – Deputy chairman of the House of Representatives’ Commission III, Ahmad Sahroni, said seizing officials’ assets that are not listed in their State Officials’ Wealth Reports (LHKPN) would violate human rights if there were no clear grounds.

He said asset seizures must be based on proof of an offence and a clear legal basis to prevent abuse of power. The proposal to seize officials’ assets not recorded in LHKPN was put forward by Corruption Eradication Commission (KPK) deputy chairman Johanis Tanak.

“However, the LHKPN rules must also be clarified, and there must be sanctions for those who fail to comply and be transparent, so that there is legal certainty,” Sahroni said in a statement in Jakarta on Tuesday (27 October 2026).

He said the immediate priority was to ensure that public officials properly submit their LHKPN reports. Many officials are currently late in reporting, or have yet to report, changes in their assets, he said.

“The KPK must ensure that all public officials update their LHKPN reports, and transparency must be guaranteed, as this is a form of transparency and accountability in public office,” he said.

Sahroni said the Asset Forfeiture Bill was still under discussion, with various approaches being considered. He said investigations and proof in court would determine which assets could be seized, and that all steps must follow clear legal procedures.

“The main focus must remain on upholding the presumption of innocence, so that efforts to combat corruption can be firm while still respecting people’s rights and ensuring the rules are not used as a tool for abuse of power,” Sahroni said.

Tanak had earlier proposed that the Bill on Asset Forfeiture Related to Criminal Offences should allow the state to seize assets belonging to public officials that are not listed in their LHKPN.

“If someone submits a State Officials’ Wealth Report, and it turns out that their actual wealth exceeds the amount declared in the LHKPN, then those assets may be seized,” Tanak told journalists in Jakarta on Sunday (25 October 2026).

He also proposed that the state be allowed to seize the assets of public officials who are required to file an LHKPN but fail to do so.
