Roy Suryo Files Another Pre-Trial Motion, This Time Challenging Suspect Designation

Roy Suryo has submitted a new pre-trial motion to the South Jakarta District Court concerning the case of alleged fake news about the diploma of Indonesia’s 7th President, Joko Widodo. This latest motion seeks to test the validity of his suspect designation. The pre-trial request was filed with the court on Thursday, 2 July 2026, and registered under case number 108/Pid.Pra/2026/PN JKT.SEL. The first respondent is the Metro Jaya Regional Police Chief, cq the Director of General Criminal Investigation of Metro Jaya Regional Police, cq the Head of the State Security Sub-Directorate, cq the Investigation Team. The second respondent is the Head of the DKI Jakarta High Prosecutor’s Office, cq the Assistant for General Crimes of the DKI Jakarta High Prosecutor’s Office, cq the South Jakarta District Prosecutor’s Office, cq the Public Prosecutor Team. According to the South Jakarta District Court’s Case Tracking System, the case classification concerns the legality of the forced measure of suspect designation. Roy’s legal counsel, Refly Harun, confirmed the filing, stating it relates to the application of Article 32 paragraph 1 of Law Number 11 of 2008 on Electronic Information and Transactions. He argued the use of the article is invalid as it lacks the minimum requirement of two pieces of evidence and is too vague. Refly expressed hope that the judge would nullify the application of the article in the case against Roy, noting the article carries a penalty of eight years’ imprisonment. He clarified that the motion does not directly request the annulment of Roy’s suspect status, as such requests are often rejected by the courts. Instead, the legal team is taking a step-by-step approach. Previously, Roy Suryo filed a separate pre-trial motion challenging the legality of a search conducted in the same case. That motion was registered on Monday, 22 June 2026, with case number 99/Pid.Pra/2026/PN JKT.SEL. The first hearing for that motion was held on Monday, 29 June, and the verdict is scheduled to be delivered on Tuesday, 7 July.
