Roy Suryo has filed a pre-trial lawsuit regarding the search of his house in connection with the defamation case involving the diploma of Indonesia’s 7th President, Joko Widodo (Jokowi). Roy Suryo is requesting the pre-trial judge at the South Jakarta District Court (PN Jaksel) to declare the search of his residence unlawful.

The pre-trial hearing for Roy Suryo’s lawsuit was held at the South Jakarta District Court on Monday (2/30/2026). Roy Suryo appeared as the petitioner. The respondents in this lawsuit, representatives from the Metro Jaya Regional Police and the Jakarta High Prosecutor’s Office (Kejati DKI Jakarta), were also present in the courtroom.

“To declare that the search conducted by the respondents against the petitioner’s residence is unlawful and illegal because it was not based on permission from the competent local District Court Chairperson,” stated Roy Suryo’s legal counsel, Refly Harun, while reading the petitum.

The following are the specific petitions read by Roy Suryo’s lawyer during the hearing:

  1. To grant the petitioner’s pre-trial application in its entirety.

  2. To declare that the search conducted by the respondents against the petitioner’s residence is unlawful and illegal due to the lack of permission from the competent local District Court Chairperson.

  3. To declare that the arrest of the petitioner by the respondents, based on Arrest Warrant Number SP.Kap/703/VI/Res.1.14./2026/Ditreskrimum/Polda Metro Jaya dated 19 June 2026, is unlawful as it violated various articles and failed to comply with the 1945 Constitution and the principle of legal certainty.

  4. To declare that the detention of the petitioner by the respondents, based on Detention Warrant Number SP.Han/458/VI/Res.1.14.1/2026/Ditreskrimum/Polda Metro Jaya dated 19 June 2026, is unlawful due to violations of procedural law and the 1945 Constitution.

  5. To declare that the investigation files to be or have been submitted by the respondents to the co-respondents are unlawful.

  6. To establish that Arrest Warrant No. SP.Kap/703/VI/2026 and Detention Warrant No. SP.Han/458/VI/2026 are annulled.

  7. To declare that the travel ban imposed by the respondents has concluded with the end of the investigation and is no longer valid.

  8. To order the co-respondents not to read the indictment before the verdict of this pre-trial motion is reached.

  9. To order the co-respondents not to submit files to the South Jakarta District Court until the examination of this pre-trial motion is completed.

  10. To restore the petitioner’s dignity and reputation to its original state.

  11. To assign court costs in accordance with applicable regulations, or to grant such other decision as the Judge deems fair and just.

For information, the police have completed the investigation of Roy Suryo and Dr Tifa. Both cases have been transferred to the South Jakarta District Attorney’s Office while awaiting the start of the trial. The prosecution subsequently decided not to detain Roy or Tifa.

The Head of the South Jakarta District Attorney’s Office, Marcelo Bellah, stated that the suspension of detention for Roy Suryo and Tifa was based on the opinion of the public prosecutor team following requests from the suspects’ legal counsel and families. Marcelo noted that the families of both suspects were prepared to act as guarantors.

“Furthermore, based on written statements from the suspects promising to remain cooperative, fulfil all obligations, follow all applicable rules, not repeat the alleged offences, and maintain a conducive situation, no detention was carried out in accordance with the applicable mechanisms and regulations,” said Marcelo.

Prosecutors have also transferred the case files to the East Jakarta District Court. Dr Tifa is scheduled for her first hearing on 2 July, while Roy Suryo’s first hearing awaits the outcome of the pre-trial motion.
