Roy Suryo, a defendant in a case concerning allegations of a fake diploma against former President Joko Widodo, has requested that a judge declare the search of his house illegal. The request was made by his lawyer, Refly Harun, during a pre-trial hearing at the South Jakarta District Court on Monday (29/6).

“Declare that the search conducted by the respondent on the petitioner’s residence is illegal and against the law because it was not based on a permit from the authorised local District Court Chief,” Refly stated.

Roy’s legal team also asked the pre-trial judge to declare his arrest illegal. The arrest was based on an Arrest Warrant dated 19 June 2026, issued by the Polda Metro Jaya. Refly argued that the arrest violated Article 29, Article 95 paragraph 1 in conjunction with paragraph 2, and was not in accordance with Article 1 paragraph 3 in conjunction with Article 28A paragraph 1 and Article 28I paragraph 2 of the 1945 Constitution, thus breaching the principle of legal certainty.

Furthermore, the motion seeks to have the detention order against Roy declared invalid. The detention was based on a warrant from the same date, 19 June 2026. The legal team contends that the detention was carried out unlawfully.

The pre-trial motion was registered at the South Jakarta District Court to examine the legality of the forced search. The first respondent in the case is the Government, represented by the Polda Metro Jaya’s Director of General Criminal Investigation and its investigators. The second respondent is the Government, represented by the Attorney General’s Office of the Republic of Indonesia and the Head of the DKI Jakarta High Prosecutor’s Office. The case is registered under number 99/Pid.Pra/2026/PN JKT.SEL.
