Regarding the Security Deposit Demanded by Pontjo Sutowo

The demand for a security deposit in the Hotel Sultan dispute case has come under scrutiny again after PT Indobuildco, through its legal team, raised objections to the execution of Block 15 in the Gelora Bung Karno (GBK) area. Chairman of PT Indobuildco’s Legal Team, Hamdan Zoelva, explained that the objection refers, among other things, to a Supreme Court (MA) circular which, according to them, stipulates that the implementation of an immediate ruling must be accompanied by a security deposit. According to Hamdan, the security deposit is necessary as a precaution in case losses arise later due to the execution. He stated that the demanded deposit value is equivalent to the entire value of the Hotel Sultan property. “Just the value of the hotel building alone, equivalent to the value of the hotel building,” said Hamdan when met at the Central Jakarta District Court, quoted on Wednesday (6/5/2026). The former Constitutional Court (MK) Chief Justice also requested that the execution process be postponed. “Aanmaning in procedural law is to give a warning to carry out the ruling oneself. Well, earlier we stated our objection. We object because there are several matters,” he said. Hamdan assessed that the execution should not yet be carried out because, according to his side, the legal process of the case has not fully gained permanent legal force. He mentioned that there are still ongoing stages of appeal and cassation. On the other hand, the Central Jakarta District Court has issued a determination for the execution of the vacating of Block 15 GBK, which includes the Hotel Sultan area. The determination dated 30 April 2026 grants the request submitted by the State Secretariat Ministry (Kemensetneg) together with the Gelora Bung Karno Complex Management Centre (PPKGBK). “The court has declared this execution request legally valid, so the determination serves as the basis for the state to immediately regulate and vacate Block 15,” he stated in a written explanation. He emphasised that the government’s legal position remains strong and is not affected by other administrative steps taken by PT Indobuildco. Kharis also assured that all procedural stages, from aanmaning to constatering, have been carried out in accordance with the rules.
