Receiving Annotated Criminal Procedure Code, Adian Highlights Importance of Legal Certainty
Deputy Chair of the House of Representatives’ Public Aspirations Body (BAM), Adian Napitupulu, has assessed the launch of the Annotated Criminal Procedure Code (KUHAP) book as a strategic step in strengthening legal certainty in Indonesia. The presence of this book is expected to provide a more comprehensive understanding of the implementation of criminal procedure law in the field.
The statement was made by Adian after symbolically receiving the Annotated KUHAP book at a launch event initiated by Commission III of the DPR at the Parliament Complex, Senayan, Jakarta, on Tuesday (14/7). The handover was carried out by Commission III member Adang Daradjatun, representing the leadership of Commission III.
The launch event was attended by a number of key law enforcement figures, including Chair of Commission III of the DPR Habiburokhman, National Police Chief General Listyo Sigit Prabowo, Attorney General ST Burhanuddin, and KPK Chair Setyo Budiyanto. Also present were members of the DPR leadership and representatives from other council fittings.
Adian emphasised that the DPR’s Public Aspirations Body, which is tasked with receiving and following up on public aspirations, views legal certainty as the main foundation in guaranteeing justice for all citizens without exception.
"The DPR’s Public Aspirations Body views legal certainty as one of the main needs of the community as a tool to ensure the upholding of justice for anyone, including those affected by state policies," said Adian.
On the same occasion, Chair of Commission III of the DPR Habiburokhman explained that the compilation of the Annotated KUHAP book aims to provide in-depth explanations of articles that have often triggered multiple interpretations among the public and legal practitioners.
As a law-making institution, the DPR together with the government feels responsible for explaining the philosophy and intent behind each provision in the KUHAP. This is important so that the book can become a valid reference for the public and law enforcement officials.
"The public has the right to an explanation if there are provisions that remain unclear. The DPR as the drafter of the KUHAP is the most appropriate party to provide explanations for these various questions," Habiburokhman stressed.
National Police Chief General Listyo Sigit Prabowo welcomed the presence of the book. He referred to the Annotated KUHAP as an important work that will serve as a common guide for officers in applying the law consistently and fairly.
"So that in its application and implementation, it can truly fulfil the sense of justice as expected in the KUHAP," said the National Police Chief.
The Annotated KUHAP book is projected to become an official reference for academics, legal practitioners, and the wider community. With this guide, it is hoped that the implementation of criminal procedure law will become more uniform, provide protection for the rights of the community, and strengthen the national legal system.
