Reasons Prosecutors File Appeal Against Acquittal of Delpedro and Associates

Prosecutors have officially filed an appeal against the acquittal verdict for Delpedro Marhaen Rismansyah, Executive Director of Lokataru, and the other defendants in the alleged incitement case involving a riotous demonstration. The appeal was filed because the prosecutors disagree with the acquittal decision.

“We respect and appreciate the decision that acquitted the defendant Delpedro Marhaen Rismansyah and others. However, we disagree with that decision and are pursuing a legal remedy through an appeal against the decision for Delpedro Marhaen Rismansyah and others,” stated Dapot Pariarma, Head of the Criminal Information Section of the Jakarta Prosecutor’s Office, in a written statement on Tuesday (7 April 2026).

Dapot said that the appeal memorandum for the acquittal of Delpedro and others has been submitted to the Central Jakarta District Court. The appeal against the acquittal of Delpedro and others was filed by prosecutors on Monday (16 March).

“On Monday, 16 March 2026, we filed the appeal against the decision for Delpedro Marhaen Rismansyah and others, and the appeal memorandum was submitted to the Central Jakarta District Court on Friday, 27 March 2026,” he said.

Harun Supriatna, Head of the Public Information and Documentation Centre of the Attorney General’s Office, explained the legal basis for filing the appeal. Anang stated that the acquittal decision for Delpedro and others still refers to the old KUHAP, allowing for the legal remedy of appeal.

“Based on the transitional provisions as per Article 361 letter c of Law No. 20 of 2025 on the Criminal Procedure Code, criminal cases that have been handed over to the court and the examination process has begun shall continue to be examined, tried, and decided based on the provisions of Law No. 8 of 1981 on Criminal Procedure (State Gazette of the Republic of Indonesia Year 1981 No. 76, Supplement to the State Gazette of the Republic of Indonesia No. 3209), except for the review process which follows the provisions of the 2025 KUHAP,” said Anang.

“Thus, for the case of Delpedro Marhaen Rismansyah and others, which was decided as acquitted (vrijspraak) during the examination period, the legal remedies still refer to Law No. 8 of 1981 on Criminal Procedure (old KUHAP), so an appeal is pursued for that case,” added Anang.

Delpedro and Others Acquitted

Previously, Delpedro Marhaen, admin of @gejayanmemanggil Syahdan Husein, Lokataru Foundation staff Muzaffar, and Riau University student Khariq Anhar were acquitted in the alleged incitement case. The judge acquitted Delpedro and others from all charges brought by the prosecutors.

“Ruling, stating that Defendant One Delpedro Marhaen Rismansyah, Defendant Two Muzaffar Salim, Defendant Three Syahdan Husein, and Defendant Four Khariq Anhar as mentioned above, have not been proven guilty of committing the criminal offence as charged in the second alternative, third alternative, and fourth alternative charges of the Public Prosecutor,” stated the Chief Judge Harika Nova Yeri when reading the verdict decision on Friday (6 March).

“Acquitting the Defendants from all charges of the Public Prosecutor,” added the judge.

The judge ordered the restoration of rights for Delpedro and others in terms of their capacity, position, dignity, and reputation. The judge ordered Delpedro and others to be released from city detention after this decision was pronounced.

“Restoring the rights of the Defendants in their capacity, position, dignity, and reputation,” stated the judge.
