PTUN Ruling Strengthens Mardiono's Leadership at PPP

The Jakarta Administrative Court’s decision to reject the lawsuit in case Number 444/G/2025/PTUN.JKT is seen as further strengthening the validity of the Minister of Law’s Decree regarding the endorsement of H. Muhamad Mardiono as Chairman of the United Development Party (PPP) for the 2025-2030 term. DPP PPP Legal Counsel Erfandi expressed appreciation and respect for the panel of judges’ ruling. He stressed that every court decision must be respected and complied with by all interested parties. “As a legal professional, I respect and appreciate the PTUN panel of judges’ decision to reject the plaintiff’s lawsuit in case 444/G/2025/PTUN.JKT,” Erfandi said on Tuesday (23/6). Erfandi explained that in law, there is the principle of res judicata pro veritate habetur, which regards a judge’s decision as something that must be considered true. Additionally, the principle of hukmul qodi yarfa’ul khilaf confirms that a judge’s ruling closes differences of opinion or disputes that arise in society. “Therefore, this court ruling must be respected. There are no longer any differing views on the Minister of Law’s Decree that appointed Mr. Muhamad Mardiono as Chairman of PPP. This decision is also erga omnes, so it must be respected and followed by all parties,” he said. According to Erfandi, the PTUN ruling further strengthens the legal basis for the DPP PPP leadership currently headed by Muhamad Mardiono. Consequently, every organisational policy and decision that has been or will be taken has a clear and valid legal foundation. “This ruling affirms the validity of the Minister of Law’s Decree which endorsed our client, Mr. H. Muhamad Mardiono, as Chairman of PPP for the 2025–2030 period. In this context, the principle of praesumptio iustae causa applies, meaning a state official’s decision must be considered valid and binding until there is a court ruling that annuls it,” he clarified. He also expressed gratitude for the trial’s outcome. According to him, the favourable ruling for PPP is the fruit of the support, solidarity, and prayers of party cadres throughout Indonesia. “This victory is the result of the cooperation and prayers of all PPP cadres across Indonesia who continue to maintain solidity and togetherness in building the party,” he concluded.
