PT GBP faces Rp214 billion sanction for falsifying SPT report

Jakarta (ANTARA) - The Directorate General of Taxes (DJP) of the Ministry of Finance has announced that PT Gala Bumiperkasa (GBP) has been subjected to a criminal sanction of Rp214.68 billion after being found guilty of intentionally submitting a Notification Letter (SPT) with incorrect or incomplete contents.

“This law enforcement action not only aims to create a deterrent effect but also to recover losses to state revenues,” said the Director of Law Enforcement at DJP, Samingun, in a written statement in Jakarta on Thursday.

The decision was issued by the Surabaya District Court. PT GBP was found to have violated Article 39 paragraph (1) of the General Provisions and Tax Procedures Law (KUP).

The criminal sanction of Rp214.68 billion constitutes a fine twice the amount of tax that was not or underpaid, which stood at Rp107.34 billion.

Samingun explained that this decision marks the culmination of the case handling process.

During the investigation phase, investigators faced four pre-trial attempts as well as the suspect’s absence during the handover of responsibility for the suspect and evidence.

Nevertheless, Samingun stated, the law enforcement process continued until the case could be referred to the court and a verdict obtained.

According to him, the synergy among law enforcement agencies was a key factor in overcoming various challenges during the case handling process, enabling it to be tried and decided by the court.

“Through consistent and fair tax law enforcement, DJP hopes to continue encouraging increased taxpayer compliance and securing state revenues to support healthy and sustainable national finances,” he added.
