PSI Says MK Ruling Tightens Rules on Relocation of the Nusantara Capital and Ends Misinterpretation
SECRETARY-General of PSI, Raja Juli Antoni, stated that Constitutional Court (MK) Decision No. 38/PUU-XXIV/2026 provides legal certainty for the continuity of the Nusantara Capital (IKN). The ruling is seen as reinforcing that the development of IKN remains within constitutional bounds and can proceed in line with the government’s planned stages.
‘Constitutional Court Decision No. 38/PUU-XXIV/2026 reinforces that the Nusantara Capital (IKN) development is on a constitutional track and has strong legal certainty,’ said PSI Secretary-General Raja Antoni in a Jakarta statement on Tuesday, 19 May.
It is noted that the MK rejected all substantive requests to challenge Article II of Law No. 151 of 2024, which amended Law No. 2 of 2024 on the Special Capital Province of Jakarta (UU DKJ). With the ruling, Jakarta remains legally the capital city until a Presidential Decree on relocating the capital is issued.
Raja Antoni, who previously served as Deputy Head of the Nusantara Capital Authority (OIKN), said that Jakarta’s current status does not hinder the development of IKN. In line with President Prabowo Subianto’s target, IKN is described as being prepared as the national political government centre by 2028.
‘Jakarta’s status as a transitional capital does not hinder the continuity of development nor the phased operational preparations of IKN as the national political government centre in 2028,’ he stated.
Raja Antoni also said the ruling also clarifies that the timing of the relocation of the capital would be set through a Presidential Decree (Keppres), which is the President’s constitutional authority.
‘Determining the relocation timing via a Presidential Decree is a constitutional government prerogative and is based on national readiness, thus ensuring legal certainty and the continuity of governance,’ he concluded.
As information, following the ruling, the IKN Authority stated that it would continue physical and non-physical development in line with the IKN Master Plan and government policy directions, including strengthening the governance ecosystem, investment, public services, and the quality of life of people in Nusantara.
